How to apply for a Partner/Spouse Visa Under New Rules

    Hi everyone. Sorry if I am posting on the wromg thread but I would like to ask for some help. Me and my Fiance will be applying hopefuly this May for Fiancee visa. My Fiance have met all the requirements financially and the accomodation. He just came back to UK 2 weeks ago after staying with me here for a month and we really wanted to be with each other again. My question are as follows:

    1) He is having a problem with His birth certificate -- do we really need to submit it on my application? Is it a must?

    2) I dont still have some of the papers as he is still waiting for the bank statement/payslip for April and his P60. He will send it to me via dhl/LBc once he get it. I have known a friend online who was on the same application before on the other forum and She said something about the duration of the bank statement and payslip. -- my question is -- is it really true that once I submit the payslip/Bs it should'nt be older than 28 days? Can someone explain it to me pleasr?

    3) Also, do I have to provide a cover letter aside from our personal/love letter?

    I asked for an assistance of agency to help me with the application and I dont think their helping me really. I hope i didnt waste 20k Php for them. I still have balance of 25k to be paid upon submitting my application online. But Im thinking that Il just do the rest my self and pay the 25k to my visa fee rather than giving them. I should have research and look for some help trhough forum like this first. they dont even know the 28days rule of the payslip.

    I hope someone could help me. I want to have successfull visa and dont waste lots of money on the visa fee. Thank you in advance,

    He can get a copy Birth Certificate from the link below, ask him to get it signed by a solicitor as a true copy (costs £5 approx.)

    The bank statements and payslips need to correspond and show his last six months salary going into his account, they need to be the latest before submission, also a good idea to include his P60 which he should have now. The financial side of the application is very important, the most important in fact, that's why you need it to be as current as possible so they have no doubt.

    Write a joint letter that you both can sign including both your addresses and contact details, just write down how you met, how you have been staying in contact, about the time he spent in the Philippines and your plan for the future. He can also state that he will be looking after all your accommodation and financial needs.

    thank you for the kind reply and welcoming me to the forum. :) He was born in the Philippines but is now a British citizen, he dont have a copy of birth certificate on NSO. That is why I would like to know if not passing birth certificate wont affect the application?

    I personally do not know if it would effect the application but if I was in your shoes I would definitely obtain a copy of his Birth Certificate from the Philippines, this way you would take all the risk away, remember, if you do not submit the Birth certificate you are just going to worry yourself sick waiting for the visa verdict, not worth the worry. One of the people here will advise on how to get a copy in the Philippines. A Birth Certificate is a pretty definitive piece of official paperwork I'm sure you'd agree.

    Wait to see what the other members come up with, it may well be the case that it is not required but I myself would not take such a unnecessary risk.

    Surely he must have had a Birth Certificate at some time to get his Philippine/British passport?

    If it means you have to delay your application while he gets a copy then it is a wait worth considering, my view only :)

    Thanks again Trimmer. He only got one copy of birth certificate, but his Mom is keeping it and doesnt want to give it to Him (personal family problem) it will cost me getting or registering a copy from the nso. Thank goodness when the time He applied for a british passport they allow Him not to give a copy of his BC. but as you said its better to give them and do no harm on the visa rather than spending lots of money on the visa fee again.

    But i hope someone else can tell me about the birth certificate as well. Thank you again. x

    If he has a copy then that will be fine, I just looked at what my wife submitted and it is a copy of her Birth Certificate, does not matter that it is not original.

    So, send a copy of his British passport, signed as true copy by a lawyer, and send a copy of his Birth Certificate, will that work?

    unfortunately He dont have even a copy of birth certificate. He will try to get it to His Mom.

    -- with regards to the copy of bio data page of His passport, does it need to be signed by the lawyer, or just a clear copy of it will do?

    Maybe just a signed as copy of original British passport will do, maybe some of the other guys here didn't submit their BC either, wait and see young lady.

    Must be a big family feud if his own mother is withholding his BC :(

    Definitely get it done by a lawyer, copy the biometric page, get him to take it along to the lawyers office with his passport and the lawyer will sign, date and stamp the copy as a true copy.

    Just get him to phone around the lawyers offices to find one that does it, I had to approach two or three before I found one that would sign it, cost me around £5 only, job done.

    Hopefully one of the guys here will post and tell you that they never sent their BC, it will be good if that happens, but remember to get his passport done at the lawyers office, that is important.

    thank you for the reminder, If you didnt mention about the lawyer, i will just pass the copy of passport without the lawyer sign. I hope as well someone filed their application without the sponsors BC and didnt affect the visa. x

    The most recent payslip has to be within 28 days of the application date.

    He can get a birth certificate. We ordered a few in the past when we needed some for IDs. Not sure it's essential, though.

    Where does it say about the 28 days Graham? Mine were more than 28 days and the visa was granted.

    I know I got the 28 days from the master, Mcawber, I think I may have seen it too in the guidance notes of the financial form, I will check. I think it may be a rule of thumb, it obviously depends on when you get paid, receive your bank statements and things like that, there will be a pattern which the case officer should be able to follow.

    3.3.8. Where Appendix FM-SE requires the applicant to provide specified evidence relating to a period which ends with the date of application, that evidence must be dated no earlier than 28 days before the date of application
