How to apply for a Partner/Spouse Visa Under New Rules

    I gather you have to demonstrate having earned for 6 clear months a rate equivalent to £18600 per annum before tax.

    That would be £1550 pm gross for 6 months.

    Significant savings can be used to make up for the shortfall.

    I get paid 4 weekly so won't that mean I just need to be earning £1430.77? Based on my own calculation (18600÷52×4).

    Yes. Thats right.. I assumed you are paid monthly.

    you need an income of £18,600. before tax--so your new income falls slightly below the requirement.--( £1500 x 12 = £18,000 )--- can you do a bit of regular paid overtime--?---or get another part time job ? you will need to produce at least 6 months payslips showing the required income. no point applying beforehand--gives UKVI an easy refusal on a plate.

    Hi. As I said I get paid on a 4 weekly basis. So is my calculation not right? (18600÷52×4)

    yes--my previous reply overlapped with yours. the main thing is--you need a minimum of 6 months worth of wage slips to prove you meet the pro-rata target.

    If you are paid every 4 weeks then it does just fit in, but you'd need at least 6 calender months of payslips first.

    It would also be advisable to get a letter from your employer explaining that you are paid every 4 weeks and demonstrating how you meet the criteria.

    Good morning. I will apply for a spouse visa soon. I just want to ask about the financial requirement. My husband is earning £1600 tax included. Without tax, it's around £1400 only. Which amount will the ukba consider? Thanks a lot!

    hi---welcome of youre new here.

    he needs a minimum of £18,600 A YEAR--( MIR )----gross---that is---before tax and national insurance---and pension contributions--are taken off. So--assuming your figure of £1600 is his monthly salary----its just over the minimum --==£1600 x 12 =£19200.

    But please note---that is the MIR for a spouse ONLY---children add to the amount. and he will need to submit 6 months payslips as proof.

    Hi.. I live in Thailand with my Filipina wife . We have been married 7 years and now thinking of moving back to the UK. It seems I fulfill the financial requirements for my spouse.. we have no kids and I have about 19500 pounds income. My question is about accommodation. We planned to live with my family until we can find suitable place to live. Does it mean I have to find a place first before they will grant any visa? Thanks for any advice

    hello--welcome to the forum

    i stand to be corrected---but i think you need your income to be derived from a job in the UK--and 6 months payslips as proof.----- ( it will be interesting to see other answers to this )

    as regards accommodation---staying with relatives is permitted--you just need proof of no overcrowding--i.e---a room in the house for your exclusive use as a couple.

    My income comes from UK pensions so I don't think there is a problem there but thanks so much for your reply.

    yes--pensions count as income----nice one ! you need to show proof--correspondence---bank statements for 6 months showing the amounts paid in. also--if there was a shortfall below the £18,600 requirement--you can show cash savings to top up.

    i would just like ask whay are the things we need to do or steps to take after getting married?my fiancee is in the uk and will come here in the philippines this january for our wedding.can anyone share experiences on what to do next before applying for a spouse visa? like registsering the marriage first on the UK embassy? thank you

    There is absolutely no need to register your marriage with the British Embassy unless you think you will need a British Marriage Certificate at some stage in the future. Your official NSO Certificate is all that you require for your Spouse Visa. UKVI will of course recognise the Consular Certificate issued by the Embassy but you don't need it for Visa purposes.

    Your wife needs to pass the English Language test at an approved center.

    She will need a TB check.

    And you will need to gather a heap of evidence to support the visa application.
