I need a BIG help please..

    Jo, If you're not planning to get married until January 2013 I think it's just going to confuse you to research and understand the current immigration rules. It is likely that the current rules will change significantly this June 2012. Apart from the 'headline' issues around gross income threshold there will be many other changes.

    I have no idea about your own personal circumstances but I think it might be helpful for you to consider the EEA route.
    Means how easy is it for you, or how open are you towards living outside UK but within the EU. Could you find a small a job?
    Having your husband join you under the EU rules could be the ideal solution.

    The EEA Route for an EEA familiy permit is more of a 'right' than an application for review and is fully and freely available.

    Generally there is no need for you, to have money, to have suitable accommodation, to have been married for more than a day or to have the spouse pass any English Language test or to make any application fee for an EEA family permit.

    Take a look at the UKBA website and do some self research. You still have plenty of time ahead of you and whatever the final outcome of the UK immigration rule changes, it's not going to settle down without considerable legal protest. Means until a judge makes a ruling the proposals will stand. Now that could take a long time.

    I wish you the very best of luck. Stay positive and try to think outside of the UK if you wish to be together in January 2013

    This is the intrinsic unfairness in the whole system Micawber, EEA is obviously the way to go, but is much easier to suggest than to actually implement in practice.

    In the case of a a young person like Jo, she has the opportunity to look for work abroad in Europe for 6 months or so but she would have to do this after her plan to get married in 2013 and then invite her partner over to stay in a foreign country for even longer and then attempt to return to the UK.

    For us older folk entrenched in whatever our career happens to be these idea's of just move elsewhere are nonsense. I actually have a tiny positive possibility that I could actually do this, I would have to convince a couple of people, people who hate the fact I am involved with a foreigner in the first place but there is a small say 10% chance I could attempt to make the EEA route work.

    It would for sure be a hell of a lot cheaper than all my other alternatives but without co-operation of people that don't want to co-operate with me there is little chance of us exploiting that route.

    Jo has a much better chance, but it will, like Kuya, put her in difficulty regards her long term career.

    It's hard to say Jo because no one really knows when these proposed new rules will come into effect, if indeed they do get passed into law, we are all just getting in a bit of a panic right now (justified panic though).

    depends on which test.

    but i just paid £140 for the pearson academic test which lasts 3 hours and has usually same day results (all computerised test)

    I think there are cheaper alternatives though? like IELTS but from what I heard you need to speak to an examiner and do written stuff on that test.. could be wrong?

    but either way both tests only require minimal marks for fiance visa...and I heard IELTS is quite easy.. Pearson one though is a bit daunting.. it shows graphs and things and you need to accurately describe them to get the higher marks.

    Just wondering..
    If I was a self employed person and I declared lets say 20K on my tax return (When in fact I only earned 10) Could I then pass this income test? Yes I realize its a bummer paying all that extra tax but...
    Dont forget.. I get paid a lot in cash which does not enter my bank account.
    Just thought I`d ask.

    Dont think it's as easy as that, you would be expected to backup your tax return with bank statements... To declare not all of your money is not entering your account is probably not acceptable, as a business is expected to demonstrate within reason the cash flow entering and leaving your business account so you can account for all of your money, if you start saying half of it doesn't go into your bank account it leaves you open to scrutiny in the respect are you doing cash in hand work which is not being declared on your tax form?

    ask your acccountant if he can do u a calculation for the visa and he can extend the amount a bit to make it loook like u do earn the right amountas that is ok

    yes thats true one part academic , and the other you talk to the comp , and yes we paid some thing like £100 as said by rb2004

    I was self employed for 15 years before I left the U.K .. The Mrs did my books and my Jewish accountant submitted all of my accounts for approx 13 years.. Cash in hand is certainly not an illegal way to be paid and the CASH money certainly does not have to go into a bank account!! You certainly do not need to maintain a "business account".
    The last 2 years the Mrs did my books and submitted my accounts to the tax office online which is rather a simple matter and much cheaper than using an accountant..
    We never had any problems about the cash money which may have or may not have been declared..(I really cant remember!!) that was given to me in my hand as that was how my customers wished to pay me.. Who was I to argue? Cash is king right?....
    So declaring more than you actually earn will not be scrutinized IMO..
    If I was trying to get my wife a spouse visa with these new proposed income rules then I for one would certainly make the necessary adjustments to my accounts.. Damned right I would!
    When Government try to make the hoops they make us jump through smaller and smaller then we sometimes need to think out of the box.
    Sad..But there you go.

    if you are a limited company the you only need a accountants tax calculation as u are an employee, of your own company
