I am in need of advice of what to get fiance or spouse visa?

    Hello e everyone. I have had a relationship with a Brit guy for 3 years now. He visited me 2 to 3 times every year. And now we decided to live together in England so we need to file a fiance visa. Should we go to an agency for that? Or where can we get a solicitor for us to help. Do we need a lawyer?
    I have a son 7 yrs old but we do not have a plan yetto bring my son to England.
    Can anyone help me?

    By the way, no need for a lawyer unless the application is complicated, the application is quite straight forward, hopefully you have never been married before, if you have you will need an annulment before you apply.

    The link I posted is a little out of date but will give you a better understanding of the requirements, it does get easier the more you research, and ask questions here on the forum by all means. Also a good idea to ask your chap to join the forum.

    Remember, if you opt to use a immigration advisor for your application it does not guarantee the visa, a few people on the forum have used immigration lawyers and had their visas declined.

    There is basically no difference, its your choice whether you want to marry in the Philippines and apply for the spouse visa or apply for the Fiancee visa and enter the UK on a 6 month visa in which time you will have to marry and apply for Further Leave to Remain.

    Thank you so much for that. But which is more faster the fiance or spouse?
    My problem also is I am not employed here and no assets. And my son will stay here as we do not have plan to bring him yet.

    Exactly the same, 2-3 months for regular application or just 10 days if you opt for the premium service (extra £500).

    Your finances in the Philippines are irrelevant to the application, your chap in the UK is the one who has to meet the financial requirement of earning a minimum of £18,600 pa.

    Thank you for that. I have heard that if we marry here we can just get the marriage certificate after 3 months so it will take longer time to get to file the spouse visa. That is why I wanted to know which is more quicker .

    I didn't think it took 3 months, at the end of the day there is no rush, just take your time and get everything in place.

    Yes it is but we are planning to come with him when he return to the UK.

    If he is in the Philippines at the moment then he can help you with the application, the problem is that he will require a lot of documents and paperwork from the UK to complete the application. best to read the thread I posted earlier.

    Fiance or Spouse Visa both will take time. Fair to say they both are not quick to get with all the preparations and such.

    Advantage of fiance visa is that you will get to the UK right away without having to wait for marriage certificate as you will marry in the UK. But, it also has its disadvantage. Fiance visa will cost more as you will have to apply for the initial entry clearance and 2 FLR (M). You also can't work and have access to NHS while on a fiance visa so that's to add to it's disadvantages.

    For the spouse visa it's advantage is that you will apply for the initial entry but will be valid for 33 months and will only apply for one FLR (M) so you can find work right away and have access to NHS once you get there. It will probably cost with the flight as well as he has to be here for the marriage to take place but if you don't mind those expenses then it shouldn't be a problem. One disadvantage of this maybe is the waiting for marriage certificate but I don't think it will take that long..

    So at the end of the day it will be your decision. Whatever decision you make, either way, it will get you to the UK and live with your partner. :)

    Our decision to go for a spouse visa was it meant just the one application and my missus has the option of working which you cant do while on a fiance visa.

    Yeah, its all swings and roundabouts regarding the two visa types, the biggest thing is whether you want to marry in the Philippines or the UK, for us it was the UK because we had both been married before and the marriage was not a big deal, its being together what counts.

    wel said timmers that's what counts the only thing I can add to that is if yous get married and she comes over she is still not aloud to work for 6 months after that time she can do so if she like sorry I can not tell yous about fiance visa

    I thought you could work on a spouse visa as soon as you apply for an NI number.

    I'm curious why you wouldn't bring your son with you. What are the reasons for that?

    Hi I was offline for longer time. He is coming next month so we can prepare the papers but not too sure yet what to get. But thank you so much for the advice.
    If ever fiance visa we gonna get . Which is the best agency to guide us?
