    It is but if we were tougher on the scroungers the deadbeats and all those who see the UK as handout city then there maybe greater scope for the genuine migrants

    Hi guys what if my partner is in receipt of PIP so im exempt of financial requirements but im working do i still need to put in my application that im working?? Thnx

    youre not the sponsor--so your income is not relevant.

    Your own earnings can be taken into account when applying for ILR.

    Hi guys, i'm looking for a little in put on my little predicament. my wife and i live in Dubai and we are currently gearing up to apply for the spouse visa. i have a job offer in the UK that will surpass the requirement, this is for a company that i worked for before i moved to Dubai and they've been trying to get me back for some time, but that's kind of irrelevant.
    This is where it starts to get complicated, the Job i have in Dubai easily surpasses the requirement but the company struggles to pay the salary on a regular basis.
    some months i get a full salary payment in my bank, some times they'll pay me half into the bank and other months none will be paid into the bank or ill be given payment in cash.
    While i have earned enough over the past 12 months that meets the requirements i'm not sure that 6 months statements will Prove that.
    Obliviously the reason for moving back to the UK is because of how the company pays me.
    Do you think its worth submitting 12 statements months and explaining the situation in the covering letter?

    That sounds sensible. Get an official letter explaining from your company regarding your new role, explaining the continuity of service, and a signed copy of your new UK contract.

    Whats the difference between Salaried & Non Salaried Employment ?. I myself have a contract stating a minimum of 10 hours per week at a rate of pay, but i have worked as many as 50+ hours per week at times over the past 6 months, I class myself as Salaried is that correct ?, but it could be that Im Non-Salaried due to the fact that my hours vary week by week, just wanting clarification of what my classification is..

    in the UKVI scheme of things--salaried means you earn the same each month. if your monthly gross pay varies, such as hours worked--bonuses--commission etc--then its non salaried--and the applicant needs to submit 12 months payslips and bank statements.

    bigmac, are you sure about this ?, because then if thats the case Im afraid that will be the end of my attempts to meet the requirements, there is no way that im prepared to be apart from my Wife for another 6 months with all that will entail..

    This is taken from "Migrate" there guide to applying for a Spouse visa.

    #5 What documents do applicants need to submit for the financial requirement?
    This depends on the employment status of the UK partner.

    • Employed for 6 months or more

    • If the company that employs the UK partner is NOT owned by either the UK partner, the applicant or by the UK partner’s or applicant’s family

      #1 Payslips for the 6 months prior to the submitting of the application

      These payslips must be:

      i) original, formal payslips that have been issued by the employer (which shows the employer’s name); OR

      ii) payslip copies that are accompanied by a letter from the employer, printed on the employer’s headed paper that has been signed by a senior official who confirms that the payslips are authentic.

      Payslips must also be no older than 28 days before the date of submission.

      #2 A letter from the employer’s who issued the payslips confirming:

      (i) the person’s employment and gross annual salary;

      (ii) the length of their employment;

      (iii) the period over which they have been or were paid the level of salary relied upon in the application; and

      (iv) the type of employment (permanent, fixed-term contract or agency).

      This letter should be the original and signed.

      #3 Personal bank statements, dating back the past 6 months.

      These must show the employment earnings being paid into the applicant’s or UK partner’s name (or jointly).

      These must also be either:

      i) original bank statements that has been issued by the bank and printed on official bank stationary; OR

      ii) online printouts that have been certified by the bank.

      To ‘certify’ bank statements, a senior member of the local bank branch must stamp or sign every page of the statement, both front and back pages.

      In many cases, they are initially reluctant to do so, so always insist, telling that it is required for UK visa purposes.

      These bank statements must not be older than 28 days before the date of submission.

      If the application is being based on the past 12 months, the required documents required will be the same as above, except the payslips and bank statements should date back 12 months rather than 6.
    I have always been under the belief that Salaried or Non - salaried only needs a minimum of 6 months, and that its self employed that need 12 months or longer.. I really am hoping that you are wrong in what you say..

    You are correct it is six months unless you have been with an employer less than 6 months then it is 12 months.
    Non salaried is explained in the guidelines as this
    Weekly gross income over the last 6 months total divided by 6 then times by 12.
    EXAMPLE
    5 Months earns 2000
    1 month earns 2600
    Total 12600 divide by 6 =2100
    2100times 12 equals 25200 which is what they use
    Page 22 covers it

    well--i'm not infallible--and ive never had to use salaried income in my sponsorship. mattecube is probably right...although i recall a time when UKVI would take the lowest months wage and times it by 12 to get to the annual figure.

    with luck--a few others will offer their opinion.

    oh--and by the way--i didnt see my fiancee for 2 years till she got her settlement visa. time flies.
