Haha yeah the struggle is real. You can't help but overthink. Anyway in theory I think they're right. They're supposed to know better than me coz they're the professional here so I'll just hope for the best. Thanks
Hi @Brom27 . We're in the same boat. We're also a same sex couple and Im applying for fiance visa. We're both filipinas by the way but she just recently got her british citizenship. About the type of visa, so you're pushing the civil partnership application through right? Can you update us here in the forum once you submit your docs next week? This whole civil partneship stuff made me really confused! Thanks!
Hi I thought you've already applied but yes it is actually confusing me now but I just have to trust my solicitor and yes I will keep you all posted.
Nope. We're still compiling the docs. We'll probably apply first week of december. Thanks again and good luck to us.
Hi, Sorry I've been idle for a while. Been busy about everything. I'll check the whole thread and will see what I can help regarding this.
But I found the process costly so what we did is, I told my fiancé (now my husband) to have a one month vacation in the Philippines so we could arrange our marriage here. With that, I wouldn't have to worry about applying visa twice. I was able to apply directly for settlement visa. During my CFO Seminar, I met a lady who used a solicitor for her visa and her visa application got declined TWICE! For some stupid mistake on basic information. Good luck with your visa application. All the best.
If your solicitor put you under category proposed civil partnership, then you can't marry under that visa. You can only do civil partnership. But technically, there's no difference on that. Just by law, both of you are civil partners and not husbands. But after that, when got your settlement visa, you can still pursue getting married.
Okay. So this has really confused me. Same sex as well, I applied for proposed civil partnership too since based on my research and understanding civil partnership caters too same sex couples. And other members here as well applied for civil partnership, and a friend that I met too while taking the ielts test. Hehehe. So if I were to change my visa application, is that still possible? Im scheduled to submit my documents on dec 16. And based on the email that I got from vfs, I can cancel the application and they'll refund my payment if I cancel it for more than 5 days in advance of the appointment date. I only have to pay the up fee. So my appointment date is on dec 16, if I cancel now (it's now almost 11pm here manila time) does that still count as more than 5 days? And do you have any idea how much is the up fee? Or my 2nd option is, rebook my appointment to a later date then cancel my application? Im panicking right now. Omg! I cant sleep because of this. I think I need a beer. Help!!!!!!!!!
Hi thank you for your kind words. There is no turning back now for me. I hope everything goes well with my application and I hope we won't regret having the solicitor in the end.
I applied for civil partnership too as the solicitor said although we are allowed to get married in the UK the Home Office still wants them to put civil partnership for same sex partners. I just have to believe our solicitor and hope for the best. There's no turning back for me now.
Okay i read the whole instruction again and it looks like i can still cancel my application since i haven't done the biometrics yet. I guess what i said about the 5 days cancellation refund if for the UP fee. since we didnt get any P then it's okay. I guess, I need to think this over first, wait for @Timmers and @bigmac or anyone's reply. Most importantly, i need to talk to my partner about this too. There's still hope. Don't think about it too much @Brom27 . you've already submitted your application so just wait for the decision. It's going to be okay. What's important is you get the visa approval!
If your solicitor is the based in UK then I'd say they know what to do on your visa application. Don't stress too much. It shall be a good news soon.
I'm not really fully sure about the fiancé visa process. But I think it should be alright for the both of you. During your appointment anyway, they will still check it if you got the right category. Although for my case, I had the correct category but the lady who handled my papers got confused and had to call her higher ups to confirm if I had it right. They advised me to have it refunded cuz they said I'm wrong when I chose Settlement - Husband instead of Settlement - Civil Partner. But I didn't listen to them and pushed through with my application. It turned out I'm right. Thanks to this forum.
Plus, marriage or civil partnership, either ways, it will make you eligible to settle in UK. I'll try to look for the document they gave me when we posted our notice of marriage. It's about the difference between marriage and civil partnership.
