What type of visa?

    Hi everyone,

    My daughter got her visa. It is really a long story and a long journey. We applied on April and we got her visa last 26 of November. My flr visa will expire this 10th of December and I already applied for Indefinite Leave to Remain before we got her visa.The question is her visa is only until the 10th of December, do we need to apply for Indefinite leave to remain for her?

    My understanding is yes you do.
    We are in a similar position my wifes daughters Further Leave to remain is due January 2020 and my wifes ILR can be applied for in September 2020 which is 28 days prior to her 5 years landing in the UK, so we will apply for her daughters ILR at the same time (Sept2020) even though she only got her previous FLR in January 2020

    So..if you had already been granted ILR..i wonder if your daughter would have got that straight away?

    Are you thinking of your wife and sons situation?
    As I see it on this link they (the dependant) have to be in the UK on the visa path.
    This is where we have lost out in the timing of my wifes daughters application what we should of done is backtracked my wifes 5 year in the UK and ILR application date and planned her daughter arriving so her firstLeave to remain ended on the date or close to the ILR application thus missing out the 2nd period.
    As it is we will apply and pay for her daughters FLR in January 2020 and then apply for her to join her mother at ILR stage September 2020.

    not as such. that is now out of the picture till she gets her citizenship. he will still be under 18, and hopefully the situation back home will have changed to make the sole responsibility issue less of a problem.

    i'm confused as to what visa he will need then--5 year route with 1 flr or straight to ilr.

    As I understand the rules he needs Leave to Remain first and then apply

    Since I applied already I have to apply separately for her. She just arrived on the 4th of December. Do you think it will be ok if we apply later on even though her visa is only until the 10th of December? I am so worried we don't have enough time.

    The 10th is today!
    I am a bit confused by the timings
    Is your daughter on leave to remain?
    If so I assume you have got her here first with the intention she catches you up at ILR
    You need to apply now,there is a limited 14 day grace period for late applications with good reasons why the application is late.

    It is a long story. We applied way back April, then they refused and then last November they overturned the decision. So we finally got her visa on the 26th of November. And because my visa is only until today the 10th, she only had two weeks. The UKVI could have at least gave us more time. But they are so cruel. Imagine within that two weeks I had to go home to pick her up and then applied for her visa right away. But anyway its done, just applied her ILR today and she's here that's the most important. I will post about how the Home Office overturned their decision.
