Visa query

    Hello people. My wife has a domestic worker visa dates back to march 2010. She entered the UK in June 2010 and is therefore elligible to apply for her right to remain in the uk next year.

    Question is will she need to renew her visa in March and then apply for RTR in June, thereby paying twice in one year or will the application be dealt with in one?

    We would greatly appreciate advice on how to proceed in this matter. Thank you

    Good question Reg, I do not know the answer myself but one of the other boys and girls might, your post was probably missed by someone who could give you a few pointers. From my point of view you could be looking at paying twice as the work visa should not be allowed to run out.

    I believe the situation is that the employer is responsible for ensuring that the visa is kept current and I suggest that the employer has a moral - and maybe legal - obligation to cover any costs related to that, particularly for an employee who is not highly-paid.

    Normally even though the visa was issued in March its effect would be in June the month she arrived here where the entry has been stamped on her passport. Just to advise when she is ready to renew her visa next year let her get the Indefinite leave to remain form and NOT the ordinary visa form otherwise she will not get the ILR visa.. Hope this help.
