Hi there. Need help I'm trying to get my wife and her 2 kids to uk. I'm self employed and have been informed by a solicitor that I need to be earning £25,000 after expenses etc to do it. That's going to be hard. Is there anybody with some good advice for me. Thinking of trying to apply for another visitor visa does the embassy allow repeat trips as she came in February for 6 months. Has anybody applied for a longer repeat visitor which I've seen on border agency website ?? Would greatly appreciate any advice/help as been to 3 solicitors and they give conflicting advice. another visit visa ? has your wife been here already then ? visit visas are for up to 6 months--but are difficult to get in the first place.
The financial requirement is in terms of gross salary - before tax, NHI and other deductions are made.
i think UKVI are likely to refuse--as its your wife : they are quite likely to think she will overstay--and avoid the visa fees they will say you need to apply for a spouse visa. so--the only way ahead is to sort out your earnings.
It need not be just earnings, if lower income then other sources can be considered. Take a look at the form and guidance https://www.gov.uk/government/publications/application-for-uk-visa-for-family-settlement-form-vaf4a I assume your wife visited on her own and left the kids behind, so this was sufficient reason for her to return? I think that visitor visa can be refused if it is used as an alternative to another required visa? Check what grants a multi-trip visa? if there is a risk of abusing a visa and potential to over stay, then a visa wouldn't be granted.
I think alarm bells might start ringing if you ask for a longer visa, from what I remember visit visas are multi entry six month visas, I'm surprised she secured the visa in the first place. Regarding your self employment, can you not prove you earn over 25k if you paid yourself more and maybe reign in some tax incentives?. The reason I am saying that is because I recently started my own company and in theory I earn less than 25k because of how the accountant is sorting my finances and tax out, realistically of course I earn a lot more. Just a thought. Good luck If you could prove you earned £18,600 you could bring just your wife here to the UK on a Spouse visa, leave the two kids for 2.5 years with family in the Philippines until such time you could afford to bring them over, again, just a thought. As you know, Filipinos are used to being separated from their families for long periods in the thinking that they are working towards a better future in the long run. my g/f left her 2 kids for 4 years when she was a student in the UK. that was when students were permitted to work--so--she supported them. thats how we came to meet. she is back with them now--but the plan is for her to join me here first--get a job--then bring them over.
You're right bigmac, you've got to look at the long game sometimes in life, I don't mind waiting for something, if you know its definitely going to come, then it makes the wait easier I think, I suspect you feel the same way with your present situation waiting for the annulment to be finalised and the loved one returning to the UK.
its been a year now since she started the application---ive got to the stage i'll believe it when i see it. i think if she does get it--then things will come together fairly quickly--by comparison.
