Settlement visa denied

    Hi! new here.

    we got married in 2005 in abudhabi. i got a cenomar (authenticated). i am aware that i have ex back in Philippines but not sure of our union if recorded or not. to cut long story short. when i went back to Philippines and apply for settlement and denied due to existing marriage back 1983. and ECO declare my marriage to my husband null and void. i didn't appeal because they are right. so what i did is to start my annulment petition as my lawyer said " na bibigyan lang daw naming ng legal na libing ang matagal ng patay"( relation that been long dead)it is confusing for me that my ex, married his new partner 2001. and i got a CENOMAR.

    so, my question is now that my annulment is due to finalised. what we should do next to validate our present marriage and apply for settlement again. we got a house back in UK and i been travelling to uk by family visit. please anybody out there who can give me an guide us what to do.. i am feed up of these and sometimes want to gave up and just go home. but my husband and my son needing me to be with them. i am disperate for help

    Hello and welcome.

    If the ECO decided that your current marriage is (in effect) null and void, I would suggest having another one either in the UK or the Philippines. You could only do this in the Philippines once the annulment is complete, so this would satisfy the ECO.

    Have you recently applied for a print-out of your civil status as recorded by the NSO? If so, what does that tell you? If according to the NSO, you are now not married and they will issue you with a Cenomar, then you will need to remarry your husband. This will be somewhat easier outside the Philippines and I would suggest Hong Kong as a possible venue. The procedure is relatively pain-free and inexpensive but after the marriage ceremony, I would advise that you file Notices of Marriage Abroad with both the Philippine and British Embassies in Hong Kong.

    The Philippine Embassy will automatically notify the NSO (via the DFA) and also the marriage will (eventually) be recorded in British records also. It will take 2 to 3 months before the NSO can issue you with a Certificate of Marriage which you can then use as part of your application for a settlement visa with UKBA.

    It may, of course, be more convenient for you to marry during your next visit to the UK, in which case there is no need for you to file a Notice of Marriage Abroad with the Philippine Embassy in London as UKBA will accept your British Marriage Certificate as evidence of your relationship.

    Kuya, thank you for your reply. that's what we intend to do after my annulment. we want to register a marriage in UK in my husband town. but i do not know where to start. shall i apply for marriage visa? we are not planning to settle in uk at the moment. we are here in Qatar still working and saving. we just want everything in the right tract.thank you again. i really appreciate it.

    Thanks for the reply, before i got married in abudhabi, i got a CENOMAR saying my name does appear in marriage record database since xxxxx till xxxxx. that's why we got married 2005. but when i went back in phils and apply for settlement UKBA double check with NSO. it appear that i have a marriage contract. then, i consulted my lawyer. and start to dissolve it. our married in abubhabi 2005 is recorded as well. my first marriage is due to be dissolve.

    ECO declared my marriage to my present husband is null and void due to my existing marriage. we need to validate it. how? and where? to start. thank you for your time reading my story.cheers

    If your still legaly married in the Phils then you cant do anything till the annulment is completed
