Hi @PaddyJoh , I am positive your next application will be successful because you really deserve it. Your GF is a very lucky woman because you will do everything just to be with her no matter what. I know you've spent too much on your previous applications and you've got a very disappointing/ annoying results. Just always remember this Filipino saying, 'Pagkatapos ng hirap, kasunod ay Sarap.'

I noticed that you are flying from Ireland to General Santos. That means your GF is from General Santos as well. I stayed in General Santos when I was in high school.

Just don't lose hope and 'ayaw kaguol'..:). (Visayan term for don't worry).

Hi Paddy - I've been in the same situation. Three visa applications under 2004/38/EC for my wife to join me on a 90-day visa (which is a right, not something that one should beg for) - and three refusals, plus three appeals refused.

There were times when I could have smashed every window in Spain when those idiots in Manila turned us down once more, or quoted some law which they had mis-applied to our situation.

Get everything in writing if possible. Your current status WILL change, and one day soon it will be over. I likened it to being on a train in a tunnel, all the noise and clattering and flashing lights, and then all of a sudden we were out of it and it was all just history, fading away behind us. Melody (my wife) picks up her residency card in a couple of weeks.....

.....Then I'm going to open a can of whupass on the Manila Consulate with a lawsuit.

@CampelloChris , nice to know your wife will be having her residence card soon. That's a relief after all the stress you've been through. I would be getting mine probably in March next year. I had just applied for my RC last month and enrolled my biometric information three weeks ago. Meanwhile, I am waiting for my Certificate of Application. I hope I will have it this week.

Sorry to hear about the result of your application @anna

Seems like lately, we had rejections not because of wrong or lack of documents but in the eyes of the ECO. Both yours & @PaddyJoh 's applications seem to be perfect and problem lies in the ECO's mood swings. You better go for an appeal. It may take a while but I think your case should be taken into reconsideration.

@anna , I hope you don't mind me asking, but have you checked all the documents and forms that ask for the annual income? There were many. Just wondering maybe you made a typographical error in one and that's what the ECO looked up to with regards to financial capacity..

Even the accountant letter he said in hes refusal that we need to provide it together with appendix2 which is very clear i have it. I have emailed them last night and today that i have meet the financial requirements but no reply yet. So hopefully this week. Im totally gutted

Seems like the ECO has really done an error in checking your application. I hope an appeal will work for you.

Did you make an appeal? How about the email you sent, did they reply? Reading back to your previous posts, it seems there was an error made by the reviewer in your application.

I have read this thread, I dont know if it is okay to post this here:
    http://www.expatforum.com/expats/br...-fiance-visa-refused-fiance-relationship.html

The applicant sent a complaint email to UKVI. Her application was reviewed. In the end, the decision was overturned in favor to the applicant. The process took 7days which was quick! I don't know if this one works with your case. But it's still worth a try but take note of the limited time to make an appeal. And I think you only have 28 days to do it?

    Hello there,
It is 100% and entirely your right to apply for a visit visa whilst you have lodged an appeal . . It is totally separate and has nothing to do with your appeal . . This was exactly the situation I was in but the problem is that the UK immigration will never look at your visit visa on a human level ie. . You have been apart for so long and now that you have had a refusal which is now in the appeal process that you , as a genuine couple , need to see each other for sanity, bonding and basic human rights! . . . NOPE . . . Im sorry folks but you must have an extremely compelling case to obtain an approval on a visit visa lodged directly after a settlement/fiance/spouse/civil partner refusal . . Otherwise you are deemed as a highly potential flight risk and never mind the 1000s of pounds spent on previous applications which obviously must show the UKVI that you follow the rules , guidelines , criteria etc etc etc . . . At the end of the day it is highly unlikely that an application for a visit visa will be successful if you have a pending appeal . . . . BOTTOM LINE IS . . AN APPEAL CAN TAKE 6/8 MONTHS . . Just work harder and fix what you have been refused on then apply again. . . Believe me , it will save time, heartache , stress and money . . . Oh and I'm sorry for my rant but that is my own personal experience so don't make any decisions based on my disappointments . . Figure out what is best for you because we all will eventually get what we want in the end . . . Paddy ☺️
