NHS Surcharge Fiance Visa

    Hi Everyone,

    I have used an immigration solicitor to help me with my Fiances visa, I checked the on-line application and paid for it on-line. I then called the solicitor and she asked me if I had paid the NHS Surcharge, to which I replied no, as I was not asked to pay it. She said it should ask as part of the application. I assured her it didn't.

    Now this would not be the 1st time that the solicitor has got something wrong, I had to tell her that my Fiance needed an English Test and TB clearance which she didn't advise me on .......

    So could anyone help me in knowing whether the NHS Surcharge applies to the Fiance visa? It isa settlement visa so I am not sure as the visa itself only lasts for 6 months and then you extend it after you are married.

    I am worried because if it is required it is an automatic rejection of the visa and I don't want to lose the money for the Visa application.

    there is NO IHS surcharge for a settlement ( marriage ) visa---what is commonly called a fiancee visa. we applied 2 weeks ago. the charge is not listed on the online app--whereas it is for other types of settlement categories. there is no method of paying it.

    thanks very much for your reply, to be honest I actaully wonder why I paid for the immigration Solicitors as I ended up doing most of the work myself, and correcting mistakes they had made.....

    Correct. No NHS surcharge payable for marriage settlement visa. Which solicitor are you using?

    No NHS surcharge on a Marriage Settlement / Fiancé entry clearance visa. Although, you will be asked for it once in the UK, got married and on the process of applying for FLR.

    Hi Everyone,

    Does anybody have some good advice as to how I can cover her medically during these first 6 months, the reason I am asking is what happens if she were to have an accident and required an operation or something that could be very costly, does anyone have any ideas of a good way to cover this?

    get married ASAP--then apply for FLR IN PERSON--and pay the IHS surcharge. job done

    Hi @Anne! So then the NHS surcharge will only be applicable when applying for the FLR? I initially thought I had to.

    If you've applied for Marriage Settlement / fiancée visa, yes. If you applied for spouse visa as entry clearance, then you have to pay for IHS when booking an appointment at VFS.

    @Sateev I would check on the Law Society's website to see if the solicitor is an accredited immigration advisor...

    But, note: A solicitor does not have to be accredited in order to offer immigration advice.


    Also check the Solicitors Regulation Authority website for any findings against the solicitor...

    on the online app--it tells you if you must pay the IHS fee--and its not there on a settlement
    ( marriage ) app.

    Don't worry - she can use the NHS from her arrival - just register her with our GP and she will be allocated an NHS number although you have yet to pay the IHS.
