I'm looking advice

    Good morning every one,im Filipina married to the British man we got married last July 2010.I m looking for advice about to my situation,we got married in phil but we cannot follow the right process to get married the foreign we got married straight with out legal capacity,I'm stuck here in Phil cause we are worried my situation or if we apply for spousal visa we get refuse cause we have no registration to the embassy. please your advice who as same situation,I'm looking forward the reply,thanks and God bless.

    If you married outside the legal system why don't you just get married again following all the required steps which will be recognised by the Philippine and UK governments, then you can apply for a spouse visa. And if you are not officially married in the Philippines then you could also apply for a Fiancée visa.

    Or am I missing something here?

    Please give a clearer picture as to what happened so that someone here may be able to offer you some advice.

    I would have thought that having not followed the legal requirement in the philippines, then your not legally married?
    You have an NSO official marriage certificate? According to Philippine Family Code you cannot be legally married if legal capacity to marry was not sought by philippine national and foreign national.

    Probably your marriage is void

    If void, then your need to marry according to the law of the country you marry in and any requirements of law in your home country as applicable.

    A british national marrying in the philippines must follow philippine family code and british policy for marriages in the philippines.

    The alternative is to apply for fiance visa and marry in the uk

    Just make it legal with a fully legit civil wedding. Excuse for another reception celebration and honeymoon. :D

    Or as OneWorld says go the Fiancee Via route and marry in the UK.

    Good evening thank u for your reply,but i have already change my status from the ID,passport,and im using the surname of my husband,this my problem how to sort this out.thanks a lot.

    As you have managed to get passport changed, you must have had NSO certified marriage certificate?
    As the marriage occurred in 2010 the rules then may have been different?
    Currently to have passport changed you need NSO certified marriage cert AND CFO Guidance Counseling Cert,
    was this done when you had passport changed?

    i've no idea if a check is made by uk visa immigration that the intent to marrying at the british embassy is actually made?
    Since there is a requirement to have obtained such permission to obtain a marriage licence.

    The UK visa immigration service may assume that the necessary requirements have been met as long as you can provide a copy of an NSO certified marriage certificate.
