ILR for dependent

    Hi friends !
    I have got my ILR on March 2015 under 10 years long residency stay. My wife came in the UK in 2007 and son ( age 12 now) came in 2010.
    I applied for their visa extension in June and has been approved for 2.5 years.
    The approval letter from home office says it was approved under 5 years rule . So they will have to extend their visa for another 2.5 years before they could be eligible for ILR.
    Some of my friends had got their ILR and British nationality under 10 years lawful stay in the UK 2-3 years ago. Their wife and kids all got ILR after 2 years of husband's ILR.
    Why mine have to wait for 5 years now???
    Did my agent filled up wrong form and applied under wrong caregory or has these rules been changed recently??

    My wife achieved ILR after 2 years, in 2013. She came under the older rules following the spousal route.

    I gather yours was gained under different circumstances....

    I have noticed that some do not apply for, or gain, ILR but keep topping up with FLR. Expensive.

    Yes , that's right. Very expensive to extending FLR every year.

    So, do my dependent have to wait for another 5 years then even if they were here more than 5 years already and living continuously under FLR???

    Did your wife arrive in the UK on a spouse or fiance type visa in 2007?

    She came as a dependent of international student

    OK, I was wondering if either had entered through the settlement route. I am not familiar with the routes you describe.

    I had a work colleague who was Cuban. He cam to the UK to study. He married a scot while here. And eventually gained citizenship in just a few years.

    I am surprised that your wife and son have waited so long, but then as I say, I am not familiar with that route in. Have they asked about applying for ILR instead of FLR, that is either the UK authorities or the agent?

    With the spouse visa the rules have changed. But that was just in 2012. Not back in 2008 etc

    Now home office has extended their visa for 2.5 years and has instructed to apply for another extension of 2.5 years at the end of 2.5 years visa. Then only they can apply for ILR ( home office instruction)
    It means my wife will have to wait total of 14 years in the UK to finally

    Apply for ILR ( legal and continuous stay of 14 years in the UK ! My god)
    And son will be staying legally and continuously for 10 years ( he is under age and will still be underage) at the time he is eligible to apply for ILR.
    So much immigration rules are going to change in another 5-6 years .
    So I was wondering , is that the only option we have to get their ILR !

    I must admit I am surprised at those time frames. There does seem something wrong about them. But I am not familiar with your wifes and sons routings.
