need help am so confuse again I am reading through some posts and the guidelines in UKBA website. And now I am confused. http://www.ukba.homeoffice.gov.uk/settlement/applicationtypes/applicationformset(m)/ "If you delayed your journey to the UK by weeks or months after the date when you were given permission to enter, that permission will expire before the end of your 2-year qualifying period. In that case, you may need to apply to extend your visa using application form FLR(M) before you can apply for settlement." Here are my details: Type of Visa: Spouse Valid From: 29/3/10 Valid Until: 29/6/12 Date Arrived in the UK: 20/5/10 * already passed the Life in the UK Test What should I apply the FLR or ILR? (this is the one that fully confused me) * Please verify if my computation is correct that the earliest I could lodge my application is on 22nd April 2012(28 days before the visa expire)?
Balot, the qualifying period for you to apply for ILR is 24 months LIVING in UK as spouse with FLR So you arrived 20th May 2010 (this is the start of the 24 month qualifying period) Your 24 month qualifying period will end on 20th May 2012 The earliest you can apply for ILR is 28 days before the end of the 24 months qualifying period. So that is 22 April 2012 (28 days before 20th May 2012) Balot your FLR visa does NOT expire until 29th June 2012 So the latest you can apply for ILR is 28th June 2012 Why? Because your FLR is valid for 27 months from date of issue. Hope you are now unconfused
