Good day everyone.........

    Where to start?? I am currently my fathers carer..... I met my girl friend 4 years ago and we have been together for close to 2 years now......... I know there is a clause for carers i could possibly get my girl friend over here in Scotland on those grounds but i have been out the country for more than 90 days in the last 12 months so that is out the question...
    I am a landscape gardener to trade so i was thinking i just need to get back into that as a sould trader but i beleive now there is no chance of that either as as a landscape gardener i make all most of my money from spring time to Autum and i know after reading all that they will mutiply my lowest months income and times it by 12 and therefor i wont meet the financial requirments........

    Is my only option now to try to find a job that earns me more than that stated £18600.00/year..... I have a house here for sale and i epect to get close to £20000.00 from that.................

    My head is all over the place right now....... I would appreciate anyones thoughts on my situation.........

    Can I ask, could you survive in another EU country for 6 months? If so, then the EEA route would be another option for you to consider. Of course it would perhaps mean a temporary carer for your father whilst you were away. But taking up residence in another EU country and perhaps getting a job or attending college there would allow you to exercise your treaty rights and have your mahal join you here in Europe.

    Then after 6 months you simply return to the UK!

    My uncle is coming up to stay in Scotland to help out with my father so i am free to do whatever it takes so I can be with the one i love.... I know nothing about the EEA route so I would have to look into that... Do i need to work or go to college there or just survive? I will have time to research this tomorrow.......

    Well, basically if you live in another EU country and are able to support yourself and your loved one (employment, self-employment, study, self-sufficient, etc) then you are exercising your treaty rights. This would mean that your right to a family life as enshrined in article 8 would come into effect and your other half could join you. Then after 6 months you both could return to the UK and your mahal would be given 5 years entry permit to live and work in the UK as your spouse. After 5 years she would need to extend it...

    Thank you for your encouraging words, that sounds easy.... If i decided to go to Spain is it just a case of myself booking a flight for myself and my wife to arrive on the same day in spain and then living there for 6 months and then entering the uk after that.. Of course if she gets to stay for 5 years and we both get to work then of course in 5 years i am sure i could meet the financial requirements.........

    No, you have to be settled in Spain first. It sounds easy but for many it isn't, jobs and stuff tend to hold us here in the UK. But if you can support yourself, think of it as a long holiday.

    Each country is slightly different, but essentially you just need to get settled in, get proof of an address and some utility bills to prove your residence and then have your other half apply. Now this would be a lot easier if you married in the Philippines first as then she literally becomes family to you and so the right to a family life is an open pathway.

    Thanks a lot for your help... Its nice work you do for everyone in this situation. After lots of thought i have decided to get a job here rather than going through the eu route and spending all of my savings... I will let you know how things are going as the year goes on...

    Had you considered trying to get Carers Allowance?

    If you are in receipt of carers allowance you will be exempt from the UKBA Financial Requirement for income thresholds.
    Instead, you would only need to demonstrate adequate maintenance and accommodation.

    In principle this means showing an income equivalent or above the current income support levels after deductions for housing costs.

    The current Income Support levels for a couple are set at £111.45 per week

    Sorry for my late reply, I have been offline for a month….

    I thought about applying to get my fiancée here on the grounds that I am my father’s carer but I would just feel better and more secure if I got my wife to be here when I can get back to work...

    I am a landscape gardener to trade so I can go back to that being self-employed but as I make most of my money from spring time to the end of Autumn and as the immigration will take my lowest months income which of course is in winter and multiply that by the 12 months then for sure I won’t meet the requirements.

    I will be going to the Philippines again later in the year to get married.

    I know I can’t sit about and do nothing for another year so I feel it’s just better I get to work and take one hurdle at a time…..

    Is there any way around this? Is it possible to just start a limited company and then just pay myself a salary over the 12 months?

    I have money coming to me soon with the sale of my house so I will have over £16000.00 in savings but as self-employed I know it’s irrelevant also..

    The whole system is just so complicated. My head is a mess right now.... what to do...? What to do??

    Hi Kev :)
    It used to be hard but it is even harder now to have your loved one with you in the UK.
    My wife has been in the UK for almost 4 years now so we are fortunate compared to others who are still waiting for this.

    From the information you've shared, you need to focus on a workable plan to meet the financial requirement.
    Either within UK or in the EU

    No offence meant. And I understand you know that, just trying to help by strengthening the priority.

    Good morning everyone..........

    Well...... I can sign off for my caring duties now so i am free to do whatever it takes to get my girlfriend over here.....
    I am going out to the Philippines to get married in a couple of months……

    I am starting to think you are right about the EA Route… What is the situation with Spain?

    Do I have to live there for 3 months or 6 months and can I come back to Scotland during that time?

    I have only started to research this morning but I see if I stay there longer than 3 months then I have to apply for a residence certificate and also I understand that I would need utility bills and things. All of that is manageable I guess….

    I have friends over in Spain who have apartments and are willing to rent me one for cheap, in return I help them fix up the apartments that they have to pay for my keep. It feels like an opportunity I can’t miss!!

    What Financial requirements do I need to go down the EU route??

    Is there a website that gives a step by step guide of how to go about this process?

    My only other alternative is to go back to landscape gardening but I understand also they will take my lowest month’s pay and times that by the 12 months… It seems unfair if I can make the £18600.00 required in 9 months but then they will take my pay for the winter months when there is very little work and times that by the 12 months of the year and then of course I won’t meet the financial requirements…

    I believe the system is up for reform at the start of April… Does anyone know if things will get easier or more difficult?
    What to do, what to do…… This stuff is hard on the head..
