Financial Requirements for Spouse/Partner Visa and ILR

    Hello !

    i really need some information !

    im a Moroccan , my girlfriend are British citizen , we planed to get married here in morocco next month but were afraid about the new laws (after 9 july 2012)

    i think id met all the requirement as i passed my English test (KET) , me and my girlfriend had met in morocco twice also we had prove of are genuine relationship.

    are problem is the financial requirement as my girlfriend can't reach that amount of 18600 £ annual shes working on a cleaning job . she had a home rent from council, she gots kids from previous relationship lives with her thats why she cant work a full time job!
    shes also my cousin and i have proof of this .
    is there any other solution can be applied as i can get into my bank account a 4000 £ if it can help ? or can i have another sponsor or i should be sponsored from my girlfriend ??

    Difficult situation,

    Are you marrying your cousin just so that you can live in the UK?

    It might be easier for her to live in Morocco with you, especially as she is unable to work full time.

    The weather is better in Morocco ;)

    i would be so happy if she can live with me in morocco but she had kids from previous relationship also she can't speak arabic :D
    is there any solution ?? is lawyer or solicitor can help ?

    Not enough information has been supplied, at this moment, to be able to give an idea as to which way to proceed...:erm:

    Your situation is not impossible, just slightly made more difficult by the circumstances.
    I don't personally see any difficulties, apart from the time and money needed to get what is required.

    I would suggest the use of an experienced Immigration adviser, even if it may be at a price.

    As the immigration rules stand right now, the applicants sponsor MUST be able to comply with Financial requirements.

    There are basically two routes:-

    1. The applicants sponsor must be earning a gross income £18600 per year.
    or
    2. If the applicants sponsor is exempt from the £18600 (due to being in receipt of any of these benefits:-
    Carer’s Allowance
    Disability Living Allowance.
    Severe Disablement Allowance.
    Industrial Injuries Disablement Benefit.
    Attendance Allowance
    then they must be able to show adequate funding equal to current Income support levels.
    The 2012/2013 level is £111.45 per week after deductions of housing costs



    Some sources of income will not be counted towards the financial requirement:-

    - Any subsidy or financial support from a third party
    - Income from others who live in the same household
    - Loans and credit facilities
    - Income-related benefits:- Income Support, income-related Employment and Support Allowance, Pension Credit, Housing Benefit, Council Tax Benefit and income-based Jobseeker’s Allowance
    - Contribution-based Jobseeker’s Allowance, contribution-based Employment and Support Allowance and Incapacity Benefit.
    - Child Benefit.
    - Working Tax Credit.
    - Child Tax Credit

    Savings may be used as either making up any shortfall in income in whole or in part.
    However, ONLY savings above £16000 can be used.
    The following equation is used:-
    (x minus 16000) divided by 2.5 = y
    Where x is the total amount of savings held and y is the amount which can be used towards the financial requirement.
    All savings must have been held for 6 months min

    There are some big challenges for you both to overcome.

    handai,

    No offence intended here, but from your previous postings I feel you would greatly benefit from a basic understanding of the UKBA requirements for a 'settlement route' visa application.

    I think a review of the forum thread here - How to Apply for A Partner/Spouse Visa Under New Rules
    might be a big benefit for you and at least put you in a position to ask questions that will be related to your own personal circumstances.

    Solely in terms of financials, you MUST be able to show £18600 per year.
    There are no important credit reference searches made by UKBA for Visa application. In fact they have no interest in affordability whatsoever, only gross taxable income.

    Please do allocate some time to review the requirements.

    You have been given an honest and valuable confirmation that credit checks are not carried out.

    Only actual annual income is calculated. The only hitch is wether bonuses are included in it.
    And if you happen to have, hopefully, a couple of grand in a saving account then it is brill, then there won't be any questions asked.

    As our friend Micawber suggested, do take some time reading the various threads on the subject, digest and ponder.

    i hear the rules are changing once again come april 2013, for disablitity living allow ie new benefit IPA,
    BASCIALLY IF UR IN RECIEPT OF THIS BENEFIT U MAY NOT GET IT AGAIN!
    INDUSTRIAL INJURIES DISABLEMENT BENEFIT IS NOT CHANGING WITH THE NEW RULES COME APRIL 2013
    WHERE DO I STAND ON EXEMPTION GROUNDS?
    DO I NEED TO MEET CERTAIN LVLS IE, WHT ARE THE POVERTY LVLS BASED ON CURRANT WEFARE REFORMS?
    WORKING FULL TIME EXEMPT FROM £18,600 DUE TO BENEFIT
    WHAT IS TAKEN INTO ACCOUNT TO STAY ABOVE CERTAIN POVERTY LVLS TO ABLE PROCESS A VISA?
    DO I MINUS MORGTAGE PAYMENTS? UTILITY BILLS? FOOD? WATER? COUNCIL TAX?
    EXAMPLE IF IM LEFT WITH £108 AWEEK NET FROM THESE DEDUCTIONS WILL I QUALIFY FOR A VISA FOR SPOUSAL?
    MY GROSS INCOME £230 DUE TO SHORT TIME WORKING HUHUH:( PLEASE HELP WITH MORE INFO

    This is a follow-up for my hubby's post. What I think my husband "malky176" wants to know is, if his current financial status would be a hindrance for our UK spousal visa application? When he was still on a regular 5-days work per week, he could surely pass the financial bracket to sponsor me. But due to recession which affected some businesses in UK as well, their work was reduced to just 4-days a week thus, reducing his gross wage/income, and moreover, reducing his net income after all the expenditures will be deducted. He is currently receiving Industrial Injuries Disablement Benefits but even if he adds that to his weekly wage, he is still left with merely £108 net a week, after all the expenses/bill payments are deducted. I believe my husband wishes to know if he belongs to the "poverty level"? Also, what is the basis for the UKBA financial capacity to sponsor me, being his wife - is it based on his gross income + benefits, or is it based on what is left after he pays all the bills, etc. (net income)? Can we also add the savings we have in UK (still under his account name) and our little savings in the Philippines (still under my account name)? (We haven't switched our bank accounts to "joint accounts" yet coz he needs to have an ACR to have a joint Philippine bank account with me; and I need to go with him personally to his UK bank to sign up documents in person, to make the UK bank account "joint".)
