Child visa

    Hi again.
    So my next scenario. Wife ,2 children.
    2 year old is mine. 5 year old not mine but I have brought him up since he was 18 months old. He has always lived with his mum only since birth till I came along. Father is unknown, due to an incident abroad.
    Anyway, what problems am I going to have to bring them all to Uk.
    Especially the 5 year old.
    Any advice please.

    You only need the visa for the 5 year old since the 2 year old is yours, I presume he/she has British passport already? There shouldn’t be a problem bringing the 5 year old especially if the father is long gone and forgotten.

    No passport for 2 year old as annulment was granted after he was born. So according to UK law he is Filipino.

    Is the father entered as 'unknown' on the elder child's birth certificate ?

    So if she got an annulment...presumably the unknown father was in fact her husband ?

    So, who's name appears there then ?

    What I'm getting at, is that if there is a father named , permission from him (in theory) may be required.

    The Philippines DWSD website may yield some useful information.

    It is normally accepted in the Phils though, that the mother has custody and control of her children until they are 7 years old.

    Ok.
    So Ex husbands name is on birth certificate. At the time she wanted to keep his name the same as her married name.
    Don’t want to go into detail but she has no idea of the real identity of the father as she was assaulted abroad by a Filipino. That person has never seen him. Anyway question is will I have difficulties for him to enter UK?
    Can’t adopt because law in Philippines state that age gap is to large between him and myself.
    Ridiculous.

    you need to apply for 3 visas--one for your wife and one each for her the kids do you meet the financial requirement and have suitable accommodation ? you are looking at around £6000 in visa fees and IHS surcharge--which will be going up soon.

    your wife will have to prove she has sole responsibility for the child, and that he is totally dependent on her. do you financially support them ?

    Yes. Supported them financially and with pre school and kinder. Moved them from Agusan to Davao.
    Sent money monthly into our joint account.
