Appeal against UKBA decision on wifes visa refusal

    My name is Jack
    I,m new to the forum and i,m here looking for some possible advice regarding my situation.

    In August of 2011 I met a lady named Beatriz here in London and we started dating and as time went on we fell very much in love. Beatriz had come to the UK on a Student Visa in 2009 and was still studying and working at the time we met.


    Suffice to say in January 2012 I asked Beatriz to be my wife. I adore this lady and our love is the one thing above all that is so strong and genuine.
    In Jan 2013 we applied for FLR outside the rules as I have ongoing medical problems I suffer with unstable Angina,although I was working I was not able to meet the financial requirements.


    We applied for a visa based on medical and under Article 8 of the Human rights act of a right to a family life.

    We sent letters of support and all associated paperwork along with the application and it was refused.
    They stated that thye could see no reason why I could not go live in Philippines with her.

    Beatriz,s parent died tragically when she was 16yrs old in a traffic accident in Philippines leaving her and a younger brother and sister orphaned.
    Aunts and Uncles stepped in and adopted the younger siblings thus they had a family life and upbringing by relatives.

    Beatriz worked and studied both in Manila and Baguio and then worked in Local goverment circles until she decided she wanted to study abroad she has obtained NVQ levels 2,3,4 and 5 and as completed all her studies.
    In June this year we got the UKBA refusal and are appealing against this decision.

    On July 17th I suffered a heart attack whilst at work and was hospitalised for 10days in West Middlesex Hospital then transferred to Hammersmith for a Angioplasty to clear out all the gunk in my veins.


    Since then I,m unable to work and doctors have placed me on Sick and I have to claim ESA with DLA/PIP claim outstanding.


    We go to appeal court on 16/01/14 in London which as cost us 2,200 in legal fees on top of the 1400 we paid for the initial application which was refused.
    I was married for 20 yrs till my divorce in 2006 and my first wife was also Filipina I have 3 great kids all born here in UK and all doing very well in life the boys now 26 and 22 and my daughter aged 19yrs.



    They and Beatriz get along great and they fully support our marriage and Beatriz as integrated into the family very well.

    The decision of UKBA that I should live in Philippines is totally wrong for one I would never survive the heat there which we know can get quite high.

    secondly Beatriz as no home to call her own there and no work to go back to.
    As a foreigner there I would never find work its difficult enough for the local people to find a job.

    And my doctors state without the daily medication which I will be on for life I will relapse very easily and it could be fatal.

    I don,t want to die out there I don,t want my kids never see me again I have family here and siblings too in Leeds and the thought of the tribunal refusing us is driving me to have suicidal thoughts


    Life without her will be no life she is everything I have ever wanted in life.
    She is loving,caring,funny a joy to be with but like all ladies as her moments but we get along great we love and understand each other very well. we always there to support and encourage each other.


    Any advice anyone can offer I would be truly greatful

    Hi Jack a big welcome sorry to hear the grief your in I am not expert in rules immigration what your talking about ,to be exempt the financial requirements needs you to require a carer ? If non of this works and your lawer doesnt fleece you. If you have resources there are other possibilities under European rules that might soon be available but I dont know if thats even a possibility for you

    Beatriz my wife is my carer but as I can,t claim carer,s allowance for her as I,m not allowed to claim from Public funds I,m in a bit of a quandry
    We will just go ahead and hopefully the tribunal will see sense

    Best of luck and please join in here as I said if being seperated is not an option there may be other alternatives but with your illness its trickyer for europe
