Hello po I just want to ask if we make a discrepancy of explanation how much we pay for the lawyer sign and stamp it . I wish is not expensive.
This is the situation my husband has a middle name Joseph . Joseph his not always use but in his divorced paper there is Joseph . But in his pAsport only first name and last name. In his mother is rose Marie George Joseph instead o George only .now I am applying a spouse visa I'm worried if this can affect my application. I ask lawyer from the here Philippines he told me my husband should have discrepancy of explanation but my husband said no need to dpi it because its ok . But I'm still worried because I know what is Philippines very strict. I tried to correct here in the nso but it will take long. I hope you help me
I can only relay my own experience in this case. My wife's name was different on the NSO birth certificate (the birth certificate was spelled incorrectly - a common thing I believe) to what was on her marriage certificate. She thought it may affect our visa application, so to be safe she had her NSO birth cert changed in her home city of Caloocan, even though she then lived in Cebu. Her aunty got it changed in the NSO office, however it took at least 4months, maybe longer, can't remember exactly. So yes the affidavit of discrepancy may be a quick resolution to your problem. Maybe other members will have advice.

He might not want to do it but he risks the visa application failing. Personally I cannot see it being so expensive but I'd certainly do it. See what others on the forum say
I don't think you need that. Just put his name on the application, and in the section where it askes for other names put his name with the middle name included. Then provide documentary evidence of both - ie passport and divorce certificate. It won't affect the application. I had some old financial documents which showed a double-barrelled surname from my first marriage. I just included that name in the "other names used" section, and included a written explanation of why that namewas on some documents.
Have still got he documents to submit? I think a cover letter explaining things would be more than enough. It's only a middle name. it's not as though the name is completely different. Just do a cover letter with the documents. Head it: Middle name: Joseph. And explain the situation. If there is any problem it will be because you didn't put it on the application form, and it's too late to change that anyway. But I don't think that will be a problem either. I don't think you need a lawyer for this. A lawyer will just take your money. That's my own feeling anyway.
Actually we have a barrister I told them already the situation he advise that the mother name is incorrect there is problem because it can change after the visa and about my husband he said if the name of my husband in our mc is not the same to passport , we can make a brief letter. But I m not confident it's because you know Phil. Is! But our barrister after they fill up our covering letter, application and financial form they don't care about us. I send email they don't reply. But they know already our problem but they don't write to the covering letter...
A barrister mighht not know the ins and outs of what is required. If you want someone to help it's best to use a reputable visa agency. A couple of us on here have experience of good ones.
If you want to do your own sworn affadavit and sign in and get it witnessed by a solicitor, by the way, it won't be expensive. About 5 or 10 quid Just do it yourself if you need to.
