Any one help with this section and paragraph of the immigration rules please,I have my own views but would welcome other thoughts please John Juby
Space Corps Directive 245zx(1): This direct reference ain't permitted. May be offensive to members ...sorry, no post it, I want to hear about the forthcoming hoop-jumping-through event I may well face myself.
Most of our Filipino members would not get the joke as they would not know anything about Red Dwarf or the character Arnold Rimmer and in this context here it could easily be taken to be offensive. Anyway it was directive 196156, you could have quoted another say 1742 or something else Not me that edited your post by the way.
in 2008 Juby came from the Philippines on a 2 year nvq carers course arranged by an agency in Manila and a school hear in London the agency did all the paperwork visa applications etc everything was going well then in 2009 she noticed her visa was due to run out at the end of the year so she raised it with the school, they applied on her behalf for a new visa but it was declined as there was more than 30 days between the end of her first year course and the start of the second year and she was advised under section 245zx(1) outstayed her welcome she exercised her right of appeal and complied with all th reporting requests ie once a week! By September2010 not heard anything and was having issues with a chap she had started seeing she decided to return home!! I met her in 2011. Do we think this will have an impact on a current visa application?
It will be for the UKVI to decide, as you will have probably seen on the application form, you have to state and give any information relating to past UK visas/visits and the like. They will obviously investigate the past visas and base their decision on that. Good luck John, a variable you could do without I feel.
John I can't see it being a problem, as long as it is declared on future applications. If anything, it has shown evidence of complying with immigration.
Im trying to obtain all the original letters from the agency and school to put the onus on them for cocking up and like you say it demonstrates honesty and compliance we have everything else in our favour in terms of earnings housing relationship its just this one point thats come tto ligt and it will be 5 years ago
I agree Timmers I was going to put it in the additional information section with the application and as many historical letters I can get hold of!!
You're doing the right thing John, try to give a simple and clear view of what happened, step by step by date order maybe as you want to make it as easy to understand as you can, I know from our two failed visit applications that the Case Workers don't like having to think too when reviewing the application paperwork. They will then have your side of the visa story and they will have course have access to all the UKVI documents regarding your wife's visa case.

Yes, she came on the 3rd August, married on the 11th October (just had to shout the missus in the kitchen as I've already forgotten the date ) and got the first FLR(M) two days later in Liverpool using the premium service, quit my job the day after that and I start my own business tomorrow. Great
The visa process was holding me up doing things in my life that I wanted to do, I didn't want to quit my job and start my own business until I had the first FLR as I didn't want to complicate things with the financial side of my application with the UKVI.
