    My wife's visa ran out on the 12/11/23
    Will she get deported I'm in the process of doing the visa now I have gone with a visa specialist marriagevisahelp if she is deported I am going to coarse a riot all of the illegal immigrants into this country gets everything for free. I'm trying to go all legitimate and we are getting shafted financialy for it

    Correct me if I’m wrong but are you still in the Philippines ? - if you are and you have your wife’s spouse visa but she has not travelled to the UK within the allocated 3 month of the Vignette period then I think you can pay for an extension ?

    You are probably aware that your wife is in a very serious position as she is classed as illegal immigrant otherwise known as an overstayer.
    Overstaying can lead to deportation jail or heavy fines and possibly jeopardise future applications.
    Normally there is a 14 day grace period after the visa deadline but there has to be exceptional circumstances surrounding the delay,
    Your past that 14 days,
    A few options your wife leaves voluntarily could cause issues departing and getting back in.
    Come clean and volunteer to local police your wife has overstayed will cause issues but at least your being upfront and the authorities finding out is going to happen at some point anyway so it’s to your credit that you have been open and honest.
    Go to citizens advice seek their help
    The authorities will pick up the expiry date when you submit a new application so I would say get into the authorities before they get into you.

    O my god the visa specialist is not getting back to me at the moment. Should I take my wife to the police station now will she sleep in a cell I don't want her to be alone

    I don’t think they will put her in jail, I think they will advise what to do and probably put her on a weekly reporting programme to the station while the situation is resolved. Take a solicitor with you or ask for the duty solicitor.

    Sorry I am ex retired police - he will not be interviewed or taken into custody for this - the police would call in immigration to deal with this

    As I said in my post "I don't think they will put her in jail I think they will advise her what to do" once reported to the police yes you would expect immigration to pick up the issue but she while the issue is being resolved will like many illegal immigrants be put on a reporting programme to try and prevent them from absconding.
    there are other ways to report an overstay but I suspect going to the local friendly police station might be a bit easier and less stressful than the below

    Get proper immigration legal advice - solicitor who specialises in immigration matters as opposed to visa advisor. Do that before raising the issue with immigration, police or anyone else.

    You are past the 14 day opportunity for late submission and the 30 day chance to leave UK so a few more days won't make much difference and better to have knowledge of options before doing anything more.

    They can hopefully advise on the art of the possible and best way forward - late FLR visa application that will probably be refused followed by immigration court appeals under human rights law or she goes back to philippines and applies for new spouse visa or maybe another alternative option.

    Bear in mind that any NHS services are now likely to be chargeable and if not cleared will potentially effect future visa, FLR, ILR or british citizenship applications. As a spouse visa you would have paid for three years IHS charge so may still be covered although not sure where you sit in this situation.

    Also worth bearing in mind that may be other issues to come with regards to right to work, ability to have bank account, rent property etc.

    You're in a right mess here... especially now they're changing the bloody rules about income requirements too!

    Get an available "Immigration" solicitor that is within travelling distance as soon as you possibly can:

    This is why I suggest taking a solicitor with her to the local police station, so she has support. The police I would of thought would take details and pass on to immigration.
    I do hope that the ops name on here isn’t close to the real name, you never no who lurks on Internet forums.

    Jeez mate you have got yourself into a right pickle by letting the application date for FLR pass you by, by the way you also need to be careful if your wife is working because her employers can/will be liable for a very big fine if it's found out that they are employing an overstayer.

    I am unable to help you except to say you have to come clean with immigration about this matter, and as others have said find an immigration Solicitor NOT an immigration adviser, some people on this forum have more knowledge than many of these so called advisers.

    Good luck whichever way this turns out, I really do hope your wife is able to stay in the Uk...

    Goodness, that really is a an unfortunate situation. Was it just an oversight that caused you to miss the deadline, or are there other extenuating factors?

    Unless your local MP is Suella Braverman, it might be worth pleading your case with them alongside getting professional advice immediately.
