Applying for a spouse visa after being turned down for a visit visa

    I have spoke to a lawyer as we can use the free hot line once. He said there is a low to medium chance that the refused tourist visa in january will affect our spouse visa.


    Basically my wife was accussed of making a fradulent application and somehow got a hold of my passport bank details tenancy agreement. They said the creditability of me spending all my savings on het trip was unlikely therefore they doubted the crediability.the guy just didnt caluclate the application correctly.

    Anyway there was no appeal or way of asking them to look at it again. So my question ia do we need to state that they previously mis administered a tourist visa?

    What was the exact wording in the refusal letter? If you can post that here that would help us understand the refusal.

    You have to state the refusal in the application anyway since they will ask it on the form if you have been refused of a visa for any country including the UK and you will state the reason there.

    Don't worry about it though as it won't affect the spouse visa application.

    Well its long but it says i am not satisfied your husband would not use all his savings. I am refusing you under paragraph 4.2 a (c)

    Basically he didnt read the application the amount i said it would cost us was 20percent of my savings

    They do come up with all sorts of things just to refuse an application. I think it is best for you to apply settlement visa, they can't argue with that anymore.

    Put it down to experience young man, many people are refused visit visas, you can always apply again addressing the reasons for refusal of the first application.

    The visit visa refusal will have no bearing when the time is right to apply for the settlement visa, you will just have to state that you were refused a visit visa and you can add the refusal reference too if you like, for if they need to carry out checks. Do not mention anything other than you were refused and the UKVI reference when you apply for the settlement visa, it is not the time to upset the case worker :)

    Remember, with the settlement visa you cannot be refused if you meet all the requirements, its not difficult, just time consuming and frustrating :)

    My wife was refused a visit visa first then applied for spouse visa and she is here now,like brom said you have to state you was refused visit visa.

    My wife's visa history....

    Granted student visa 2008...for 4 years.returned to filis aug 2012

    Applied for visit visa 2013...Refused!

    Applied again 2013...Granted...Lived here with me nearly 6 months till Jan 2014

    Applied for fiancée visa Dec 2015..Granted Feb 2016.

    Applied for flr 2016..Granted same day.

    yes, sometimes if the documents will not satisfy them they will refuse but you can make an appeal or re apply, my wife did the same when her visitor visa was denied. you have to convince the reviewing officer that all the paperworks and documents are legit. my wife had already been here so many times then we stayed for a while in the philippines so when i returned in the uk her visa already expired so we had to re apply, then she did not tell me that it was refused, she asked more documents from me, then submit all explaining the issues why the prev officer was not satisfied, then she also mentioned what she had done to respond to it. then she got approved!
