My asawa entered the UK in Aug 15th 2015 (5 year plan), and her biometric card expires Feb 2021, so we are starting to prepare for the ILR (M). When is the earliest we can apply? Is it 28 days before Aug 15th 2020, or 28 days before Feb 2021?
A spouse can apply 28 days before the 5th anniversary of her landing in the UK. For example my wife arrived 10 October 2015 so she can apply at the earliest 18 September 20 20 and upto when her BRP runs out in Feb 2021. I was just saying that Steve applying in August is 2 months ahead of us
Hi @Mattecube thank you for your reply. I knew what you meant! I was 99.9% certain we could apply 28 days before the 5th anniversary of my asawa stepping foot on English soil. For example, the period between arrival in the UK and the start of the 5 year spouse visa counts towards the 5 years...There appears to be confusion surrounding the earliest date the ILR application can be made, but it looks like it is 5 years from arrival. Hi Steve I am very clear on it. It is 28 days prior to 5 years from when they set foot on UK soil as I have said in 2 posts now. You can apply at anytime after that upto the BRP running out
Doing it as soon as you mean? Can apply for British citizenship as soon as you get it! Access to public funds including NHS Other than that not really looked into it.
Incorrect it is a five year journey the applicant embarks upon and that is when you can apply 28 days prior to the 5th anniversary of landing in the UK . One of the reasons and perhaps the main reason is the delays by HO in dealing with applications . My wife's BRP runs out in Feb 2021 by then she will of been in the UK approx 5 years and 5 months we applied in a timely manner at all stages it is not our fault the excess 5 months! They (HO) are being fair it's28 days prior to 5 years yes 28 days prior to .5 years from landing in the UK.
Just to complicate the issue, if they arrived on a fiance(e) visa - which doesn't count towards the 5 years, I believe? - when does the 5 years begin? Is it a) the Issue Date on the first 2.5-year BRP; b) the date of the marriage, or c) some other date? It's probably explained in the cover letter received with the BRP, but thought I would ask.
If you have come over on a fiancee visa the 5 years start at the commencement of the first BRP card ie the valid from date.
well--its swings and roundabouts with fiancee vs spouse visas. in our case it doesnt really make any difference when my mrs applies for her ILR then citizen ship. still gonna cost me!
