Spouse Visa - Online Application

    That’s what I assumed; she’s obviously legally entitled to be here until at least Sept 20th and then until the application decision, so it sounds like her employers are clueless and covering their backs.

    I’ll check online later to find something ‘official’ stating she’s OK to work and forward it to her workpl
    Found this site earlier and entered Joan’s details plus the reference number we were given when I paid for the application.

    Apparently her employer has to fill in an online form of their own to check her work status with an answer within 5 days.

    Nothing straightforward when dealing with the Home Office of course, and yet again it’s a BETA website....

    I'm pretty sure the letter from UKVI stating they've received the application should be suffice. This is what two employers I know (My Wife's, the NHS) and my Office Colleague. From my expereince It's often Care homes Head office who ironically, have no idea to manage & care for people screw up on something like this! :mad:!

    the thing is--employers face a massive fine if caught employing someone who hasnt got permission to work.

    It really should be straightforward - if an application has been submitted and the applicant is in the country legally while the application is being dealt with, the right to work should apply unless the application fails and he/she doesn’t fulfil the criteria for another visa.

    My wife's spouse visa has expired last 27th June but since we have submitted the application since 29th March, then she is still legally allowed to be in country until a decision has been made. Her employer also asked these documents (i.e. confirmation of submission of visa documents for FLR) and they have applied her for a temporary work visa for 6 months, whilst awaiting for the decision.

    We are also following the application through the contact details from the UK Gov website several times already and the telephone operator on the other end, always tells us to just wait as it is still in process. Obviously, it is approximately 16 weeks now since we have submitted but we still not have any decision yet. The Home Office are not getting in touch with us anyway for any further requirements on documentations that we need to pass or failed to submit. Since we used the new UKVCAS, they are checking all the necessary documentation before uploading it, as part of the application process so we should have passed all relevant documents required.

    Anyone that has the same situation, or has been with this situation?

    Appreciate your responses and advices. thanks in advance.

    Just to confirm the A1 English language test that my girlfriend took for her fiancé visa is acceptable for the spouse visa that I will apply for after we are married?

    Yes, as long as it’s within 2 years of taking it, they expire after 2 years.
