Spouse Visa - Online Application

    Hi,

    To prove custody, would this be sufficient? Coupled with me sending a copy of my current contract that includes my step daughters education and medical care

    hmmm--interesting. with a signature the sperm donor abdicates his responsibility and obligation to his child. Whether UKVI will take any notice of it--who knows ?

    you have to bear in mind the UKVI decision maker is a nameless faceless civil servant charged with legally refusing any application where possible. the only options you have are

    1 make the application and see what happens
    2 hire a lawyer to make the application and see what happens.

    then be prepared for a refusal--in which case then be prepared to take it to court--to let an "impartial" judge decide. this will take a lot longer--and a lot more of your money.

    or--UKVI may then back away and say yes--its a case of who blinks first.

    we went for option one...and was refused.

    I think you have a strong piece of documentation to support the application.

    They are in situation that father is US citizen living in Manila which makes case bit stronger as father will be subject to visa restrictions in terms of staying in Philippines. Also mother will have sole responsibiltyfor child under Philippines law and they have good evidence in terms of stepfather looking after child in terms of medical and education as they are benefits of his job.

    Ideally would have time to do step parent adoption in Philippines as that would resolve most issues as they have been living in the Philippines for some time.

    @Stevembe did something similar although father was based overseas so should have decent chance.

    Would also need to get copy of information page of father's passport as they like to check signature and @Stevembe was asked for that during the visa process.

    Who said it will be easy? It's a strong document to have to support the application!

    i'm of the opinion any dependent child application is likely to be refused if the father still exists.

    so based on my experience when we re-apply i will use a lawyer and expect refusal and then appeal. unless--in the meantime there is a test case which results in a change of policy at UKVI--who then approve such applications if the child wants to exercise their human rights to live with their ( mother ) [ or father if he is the one settling in the UK ]

    So starting to go through it online now ..so I’ll be putting I’m applying for someone else?as I’m applying for fiancé Visa of course..this is right?

    The decision on your UK visa application with reference number GWF has been made. If you opted for courier delivery at the time of submission, your passport will be delivered to your chosen address. Alternatively, you may collect your passport at the VAC from 14:00 – 16:00 Monday – Friday except on Embassy declared holidays.

    Now the next day or so are going to be a nerve wracking time.. luckily i can keep myself busy..

    So its a 5 hour round trip by Jeepney & Bus to Valencia for the wife to collect her Passport to from the 2 Go office in Valencia, so much for the Door to Door delivery, but its nothing less than what we expected, can only hope this journey has been worthwhile :D. No txt to say its ready for collection great service from 2 Go as usual..

    That's bad news, sorry to hear that.
    What reasons did you get for the refusal?

    Basically they ripped apart my application, I am absolutely fuming..

    1. I did not provide my Decree Absolute, though i included my Affidavit; The Giudance notes do not say include the Decree Absolute.

    2. The Employers letter does not appear to originate from my Employer; But it is, and does, and he said in the letter phone him if there is an issue.

    3. Evidence a Pension; I did not supply a letter from the DWP saying when, and how much my Pension is, though they say I have submitted Statements showing my Pension income, I have not submitted a letter.

    4. Cash Savings; Though i have shown i have in excess of 30k, they say have not been held for 6+ months, The balance was £269 on 7/6/2018. Actually i submitted them with statements going back to 2015 whereby it shows this has never dropped below £30k+ albeit they were held as shares.. shares can be counted towards available Cash. I only had £269 cash. No mention of my Current account Statements which i submitted, and have a an amount less than 10 K but more than £5k ;)

    Have to go now, need to earn some money looks like there maybe an appeal or a Solicitor to pay for now... :frust::frust:

    Its going to take more than some "Jobsworth" sitting behind a desk, whose remit appears to be deny at the slightest reason.. I will fight this if its the last thing that i do, I just feel sorry for my wife who is at the other end of this having to receive the bad news, bearing in mind it was only a few years ago that she had a visit visa request refused..

    bring on is what i say.. :boxer::boxer:
