Isnt upping sticks and heading off to join a terrorist organisation an offence?

It might be if you can prove that that's what she did.

She has admitted it,she went to join a proscribed terrorist organisation, her geography, her story, her admission, whatever info was taken by the security forces from her PC when she fled,i am sure that case is watertight.

I would like to think so too but without further independent evidence, her defence barrister will drive a coach and horses through that. The ramblings of a dillusional and confused school girl.

She isn't a school girl, and her geography, story and admission are those of an adult.

It's a bit late for that but there is an encouraging development. According to her captors, she worked for a year or so in jihadi hospitals in Raqqa where her duties included nursing sick and wounded ISIS fighters. That's giving succour to the enemy and is treasonous.

Apologies if this had been said already

If I go to say philippines and commit a crime I am tried there.

This woman has broken the law in Syria so why would any one think she should be prosecuted in U.K. ?

If she subsequently returns to U.K. after being dealt with in Syria then she can be prosecuted there if she has committed a crime/s there.

    Seems pretty simple to me

Because Syria is a failed state. It does not have the resources to prosecute the thousands of jihadis within its territory. The Syrian government is also fighting wars on different fronts. There is ISIS, Western backed rebels and the Kurds. I don't think anyone outside Russia would trust Syria to offer fair trials to all these people.

The Kurds have suggested an international tribunal. This would be the ideal scenario. I can't see the Syrian government agreeing to this as it would probably not be long until questions are asked of members in the Syrian regime.

These leaves the only realistic option of member states trying their own returning citizens.

As a former CID officer I know there could be considerable difficulties involved with bring a prosecution in U.K. That would be especially so with possible crimes committed outside U.K.

I just heard that her father, now living in Bangladesh with his second wife, thinks she should not be allowed to return to U.K.

If she hadn't gone out of her way to become such a media star, she could most likely have sneaked back into the UK without anybody noticing.

Now her only hope is a burka and a false passport.

    Dave.
I do not follow your understanding.

She appears to have been found by the news media who have exploited her for a story.

Stupidly she appears to have been honest in her comments and all but ruined her chances of getting quietly to U.K. Had she engineered it surely she would have appeared contrite to improve her chances of getting back to U.K.

From what I read she used the news reporter to contact her family in London. So hardly exploitation more an exchange.

If she wants to return then she should be tried for treason along with the rest of the returning jihadis. Once found guilty, she should serve a whole life sentence.

Apparently the news man interviewing her suggested the method got contacting her mother

The last prosecution for treason in U.K. was in 1945 so very unlikely in this case

Yes I know, Lord Haw-Haw, I believe it was and he was also one of Albert Pierpoint's last clients.

I note that the Home Secretary is to update the law on treason so that it is possible that it can be used

I am not well informed on the facts necessary to establish a successful prosecution for treason however, that it has not been used for so long as I said I think it most unlikely a successful prosecution could be secured. Also proving what the woman did to support such a charge would mean proving what she did in Syria. Difficult I think

Even if the law is revised/ up dated it is extremely unlikely it would be retrospective so probably no use.

Markham, I basically agree with your understanding, “.......... without further independent evidence, her defence barrister will drive a coach and horses through that. The ramblings of a dillusional and confused school girl”

Well! They should tell her to go to Australia where they sent the unwanted British prisons in the history. so she could go and start bombing my mother-in-law in Brisbane!
