Retiring judge Lindsey Kushner issues drunk women rape warning

    I found this article quite an interesting read, words from the lady judge regarding rape;

    Lindsey Kushner QC said women were entitled to "drink themselves into the ground" but their "disinhibited behaviour" could put them in danger.

    The statement above rang a bell with me because its exactly what I have thought when I've been in city centres late at night and seen lone young ladies staggering about trying to find their way home.

    In reply Rape Crisis stated;

    "The only person who is responsible for rape, is the rapist.

    "Women are yet again being blamed for rape."

    Again,I agree with the above so I do appreciate both sides of the argument, but I do have to agree with the judge that women do put themselves in danger when they've had a skinful, especially if they wonder off alone.

    I lean towards the view held by Rape Crisis, I understand what the judge says, and Ive listened to a lot of viewpoints on the radio today but conclude and agree with Rape Crisis.

    I can see both sides of the argument, the biggest thing for me is I hope that what the judge said doesn't put women off reporting a rape.

    Its a very sensitive subject as we have seen on the news that the courts can get it wrong.

    The thing with bringing drink into the mix, that alone clouds what could have actually gone on between two individuals involved in a rape trail, especially if both parties had been drinking heavily.

    Difficult subject without a doubt.

    And to be fair given that the judge has probably sat through many distressing hours of evidence she is entitled to give a balanced view.

    I agree completely with the judge. If you get stone drunk and walk home through a dodgy neighborhood alone late at night and you get mugged, nobody is saying its your fault or that you are in any way responsible, but the fact is you did put yourself in a dangerous situation.

    Very true, a prospective rapist/attacker is more likely to accost a obviously worst for wear young lady than a sober one, that's my assumption anyway.

    Rape Crises would suggest that it is the rapist who is the danger and that a women is allowed to drink if she wishes without being in danger from predators however we live in the real world and that is what the judge eludes too. 2 sides to the argument I guess but any drunk male or female is a danger to themselves and others.

    If I get totally rat-arsed and stagger through the streets at 2am, or collapse in a stupor outside the kebab shop, there is a chance I'll be mugged. I've made myself an easy target.

    This doesn't excuse the muggers for committing a criminal act, but I haven't helped myself through my own irresponsibility.

    There is a bit of a double standard because I am at very low risk of being raped. However, young men are more likely to have the crap kicked out of them by strangers, and women more likely to be raped by a stranger. Swings and roundabouts. Every man and woman needs to take all prudent steps to keep themselves as safe as possible.

    Even more worrying for our drunken young ladies... considering the huge number of undocumented young males with 'lack of opportunity' and often the Neanderthal views of their home cultures firmly embedded, now wandering our streets.
    Of course, another subject to be swept under the carpet by the PC bleeding heart brigade.

    To me, the comments of the judge are totally sensible and ring true.

    The comments by Rape Crisis are missing the point as these type of people often do. The judge isn't saying it is their own fault, just that they are putting themselves in a dangerous situation. And they are.

    I'm pleased she has started the debate on the subject really, I'm guessing that a lot of rape cases/allegations involve alcohol in one way or another.

    I was surprised by the response from Rape Crisis as I understand that the advice appears on their website though I have not checked. The judge very eloquently said that too much alcohol can make you a target for rapists, its wrong, its inexcusable, but its true. She was not trying to justify rape.

    To me the judge just stated the obvious and should have been applauded for joining the debate, not shot down for her comments.

    anyone who disrespects a woman like this needs a cut in their forehead, so everyone else can see what this person is regards to society, they made their choice.. doesn't matter how drunk you are, if you force a lady, you are a brute. And if they did it on my girls, you'd be dead.. I'd quite happily sit in prison for murder if that nonce was dead.
