Yeah I've read it Kevin. I know you had a lot of trouble with your eyesight during your detention are you finding these posts on this forum difficult to read? I am asking because we could use a larger font when responding to you. UKF is for Charlene Junior born before 1st July 2006. I still think that Charlottes claim needs to go through the MN1 route.
Ah ok there was a typo at the start of the thread in post #4 where you said Charlene Jr was born on 19th June 2006, the cut-off date where UK law changed was 1st of July 2006 so both children should go the MN1 route. The UKF form is explicitly for children born before 1st July 2006, so I think the people you spoke to have given you bad advice. edit: see the title of the UKF guidance below:
The form is explicitly for children born to a British father where the mother was married to another person.... also the fees are wavered on the form whereas the MN1 route is for fathers without any difficulties... ie the process is basically straight forward. Im afraid to say my case isn't.... Sorry about the typo.... and yes the font is small but so are the keys on my phone,,, so normally its 2inches from my face The advice I was given was from the passport office and also the homeoffice citizens advice line,,, I also got advice from citizens advice and they all say the same.... use the UKF (M) form.... and if I can make the attempt from the UK ..... so thats why I'm asking help from my MP.... who is totally different from Justin...
The Problem Kevin is that UKF is explicitly for pre 1st of July 2006 Births. I am not sure that the people you have spoken to have fully understood your circumstances. It's looking like you need professional help from someone who understands the law.
Can I ask again, was the ex husband Filipino or Foreigner? And is your name on the children's birth certificates?
The ex husband is a filam.... uses his American citizenship... and my name is most definitely on the birthcertificate and on their Filipino passports.....
Ok but I take it he has divorced Charlene in America so he has used his US citizenship? That should make it a legitimate divorce in Philippine terms, as he is free to remarry in his country of residence and that is the rule that governs recognition of divorce in the Philippines. And that is really good that your name is on the birth certificates. Hope the larger text helps a bit.
Kevin I agree that UKF (M) is the correct route. And under this clause on page 5 you will get it, all of these bulletin points are OR conditions (I'm not shouting that's a programming logical OR) You are on the birth certificate and that will get you recognition for your kids. This is the Page 5 quote.

This is for the biometrics requirement? This is not fair they should be able to do that at the UK Embassy in Manila but the Embassy is a hollow shell it does almost nothing for us now
The UK law defining a child's father as being the husband at the time they are born is asinine and ridiculously unfair when means of absolute proof are readily available these days.
I would just like to say a big well done for ALL you guys trying to help Kevin with this he has had a very tough time in the Philippines for a number of years, even now he is back home in the Uk he needs all the help he can get to get through the oceans of red tape to enable him to have his kids join him here. If ever i can help in some small way just give me a shout i will do my best..
Hi Kevin, You have had to overcome many obstacles in the Philippines but you did it which shows what a magnificent fighting spirit you have. Many people would not have been able to do what you did, so you will get through this challenge too. Never Give Up
