just joined and need visa advice

    Hi Just joined and have several questions ree my own family. However need some advice for my friend at work. He has a filipino partner and she has visited Uk couple of times on visitor visa. He went to Philippines in May and they got married. They couldn't come back together due to travel restrictions with covid 19. His wife finally flew back to UK couple of days ago and he needs to know if he can either extend her visitor visa or can he go for Leave to Remain visa. Im not usre myself as my partner originally came over in 2012 on fiancé visa so was different for us. Any advice would be appreciated as he's getting a tad stressed over it. Kind regards Les

    Welcome Les.. Hmmm thats an unusual way of doing things. He/She needs to apply for a Spouse visa the point im not sure about is if she can apply for a spouse visa from within the Uk, because normally the first visa issued is Leave to enter the Uk. You need to find out first if they meet the requirements such as what you had to do Les, I assume that they meet the financial requirements, but then their is the issue of english language requirement, TB test, plus the CFO, personally i dont think they can apply for a spouse visa whilst in the Uk, but im sure someone on here will confirm this.

    i was puzzled when i first read your post--thinking how on earth the wife was allowed into the UK without a settlement : spouse visa.....but i guess her visit visa still had time to run. they are multi entry.

    unless anyone can prove otherwise..she will have to leave the UK and apply for a spouse visa--if she wants to settle here. meanwhile, on a visit visa she is not entitled to NHS benefits ( except emergency ), nor can she work.

    Hiya, she still had time left on her visitors visa so that's why they allowed her to return. Obviously he's trying avoid the considerable extra cost of her going back, reapplying over there and then the extra flight costs. Will let you know how he progresses.

    Why do that? Should be able to ask the system for clarification.
    It will either let them proceed or not

    Yes once you say yes your on a visa, early stages of application see what system says, of course they may not of updated the programme to accommodate the update on the link supplied but it's a start point.
    I think he has a good chance of getting the application processed given the wording of the paragraph I pointed too
