Advice please

    Hello,

    My thread is about a difficult subject. Basically my Filipino Wifes Father has just died and she wants to go back to Philippines to be with the family. Unfortunately her passport is with UK visa and immigration being processed for a Spouse Visa. About 6 weeks remain until we get it back. Also we have a 15 week old daughter with no passport at the moment.

    I have looked at getting the passport sent back but I can only do this if I withdraw my application.

    Has anyone been in a similar situation and might know how to get her passport back sooner?

    Surely they could put the application on hold and send it to her on compassionate grounds?

    Wow, that's unbelievably unfortunate timing and sorry for your loss. Is this her first flr(m)? Or does she already have a BRP? If she does and your waiting for the 2nd 2.5 years, contact the Philippine embassy and see if they can issue a travel document. On her return she'll still have same UK status, as long as she shows the letter confirming the 2nd flr(m) is in process, I would assume she's no problem entering UK again

    very confusing. your wife has applied for a spouse visa from in the UK ? or do you mean her Further Leave to Remain ?

    Sorry, I missed the baby issue. I'm guessing at best she'd need to stay in UK

    Hello bigmac, she entered uk on a settlement/marriage visa, now we are married we are converting it to a Spouse visa (FLR) m I suppose.

    yeah it's sad.

    it's our first of the 2.5 year visas. we don't have a brp yet but we have applied.

    I'm trying to convince her to wait until the visa is processed instead of withdrawing the application and having to do it all over again from outside the UK.

    She could of moved from a fianceè visa to spouse application.

    I would contact the Philippines embassy in London see if they can help advise.

    When does her settlement : marriage ( fiancée) visa expire..?...it was a 6 month visa. Is it multiple entry ?

    a very difficult time for you both. i think she will have to remain here with you and your baby. she will have to contact her family and let them know the difficulty. i'm sure they will understand.
