A friend need an advice

    Hello Everyone,
    A friend need an advice about settlement visa. She's married to a British citizen have two. Her situation is husband work abroad that is why they live abroad. It is possible that she can apply for a settlement visa? While the husband still working abroad. They have a house and she's been in and out the uk.

    I would have thought that he would have to have his main residence/address in the UK before being able to sponsor his partner for a settlement visa. That before meeting all the other conditions, such as accommodation, employment/income, etc.

    @graham59, they have a 5 bedroom house in Scotland the wife is been here in Uk since 2012. I just don't really what exactly visa she had before. The husband work abroad since they're have children that is why they wanted to apply a settlement visa.

    Oh well, I think it's best to just advise them to look at the UK Immigration website then.

    All the rules and regulations can be found there... and they can decide whether or not they are likely to be able to comply with them. :)

    The husband must be resident in the UK if she wants to apply for settlement.

    I think we need more clarification here.

    You say in your first post that they live abroad. Later you say the wife is in the UK and has been since 2012.

    It is important to know what visa she is on at the moment I think.

    Is she living in the UK while he is working abroad? He would need to be settled in the UK to apply for settlement for her.

    I'm curious to know how she is living in the UK for 4 years but only now thinking of applying. I think you need to find that out first.

    Agree with earlier posts. He will need to be present and settled in the UK and considered to be a resident.
