SUCCESSFUL CHILD SETTLEMENT VISA/SOLE RESPONSIBILITY/ILR/CFO

    Hi Guys,

    First of all, let me all thank you for all your support and advise on my journey on applying for a Settlement visa for my 12 years old daughter.Apologies if I only posting this now as I have been to the P.I for the last week to get my daughter.

    She has been granted an INDEFINITE LEAVE TO REMAIN.

    I am a parent that came to the UK under the old rules,(before 09 July,2012) and became a BRITISH CITIZEN on April 2013.

    Application Submitted online on the 13th of October, 2015.
    Documents and Biometric Submitted at VFS on 22nd of October, 2015.
    UKVI asked for further documents proving that I have been visiting my daughter in the Philippines on the 25th of October, 2015.

    30th of October,2015 I sent the documents they have asked for (Copy of my old passports showing that for the last 10 years, I have been visiting her almost every year.

    11th of November,2015 Visa Granted.

    22nd of November, 2015, CFO STICKER RECEIVED.

    28th of November, 2015, Entered the UK.

    DOCUMENTS SUBMITTED

    Online application form with Appendix 1
    Passport
    Birth Certificate
    Baptismal Certificate
    Certificate of Enrolment

    Mother/Sole Responsibility
    A cover letter stating why I am applying for a settlement visa for my daughter ( in my case my parents who is looking after her can no longer care for her due to their ill health...,my siblings both have their own families therefore there is no one in my immediate family can care for her.)Submitted an ongoing medical treatment records of my parents
    My old and new passports
    My Birth Certificate
    Emails from her tutor addressed to myself
    School letters sent to me by her school

    Sponsor (HUSBAND) SELF EMPLOYED
    Cover letter stating that we has enough money supporting her
    His passport
    Accountant's Letter
    Last years tax statement
    6 months business and personal bank statements
    Land Registry documents
    Utility Bills

    This is only a summary of the processed but I will answering any questions.

    hello! glad that u have done it successfully on your own. I am under fiancee visa when I came in here in UK. We got married and I am now applying for FLR soon. When granted a visa, we would like to get my boys from the Philippines to stay with us here. What type of visa should I need to apply for them? is it the same as yours Jhen? I hope u can help me as we don't have funds to get a solicitor for the visa application of my boys. Thank u in advance

    Hi Ginger, if you like your boys to live with you permanently then yes it's the same as my daughter's.
    I believe that as long as the application is straight forward there will be no need to pay extra money for a solicitor...,as long as you can prove that you are still responsible for them ,( proving sole responsibility was my biggest worry) .This forum helps me a lot.

    There are a lot of very knowledgeable members in here so I am very sure that when you come to apply for their visa, there will be a lot of advise you can get in here.

    First of all, take one step at a time, think of your visa first and not worry. Based on my experienced, what will be , will be and that if things do not work out the first time...,it will work out eventually.

    Alright, thanks a lot for the info. I would just like to ask also if I get the 1st FLR visa, what type of visa should I apply for my boys? coz we are planning on getting them hopefully this year so I am already starting to gather information on how to do it, at least to just give me an idea. By the way, how long have u been here in UK Jhen? as u mentioned u have to show proof that u have been visiting your daughter for the last 10 years. Thanks again...

    Hi Ginger, I have been here in the UK for the last 6 years. I entered under the old rules and under an Unmarried Partner Visa. Get my residency after 3 years and applied for Citizenship straight away. Been naturalized since 2013.

    For the last 10 years, my daughter was looked after by my parents in the P.I but unfortunately last year, they fallen very ill that they cannot attend to my daughter's welfare anymore. I have visited my daughter almost every year for the last ten years.There was not much on the document I submitted for her settlement visa. My old passports and immigration stamps to proved that I have been visiting her was provided to the UKVI.School letters adressed to me and money remittance receipt.

    I advised you to gather as much document as you can regarding your involvement on making key decisions regarding their welfare and care in the Philippines. In my case, I have the sole responsibility for my daughter meaning her father was never involved in her life. I think, that was one of the reason she has been granted a visa.

    Hello Jhen! I am back again. I have successfully gotten my FLR visa. This time I am starting to gather information for my 2 children. We plan on submitting the application on August because we are waiting for my husband's 6 months pay slip covering his new wage that would qualify for the financial requirements. What bothers me now is because we are applying them for a visa on August, I was thinking of not enrolling them anymore this June since it cost a lot of money and they will just stop by the time they get their visa. I have read your list of requirements here and u included enrollment certificate. Is that necessary? Can I just used their previous school records? I am staring to worry now as we do not have plan on getting a solicitor. I hope anyone can help me here. Thank u so much

    Frankly I would enrol the children anyways.
    If your visa application is delayed or not successful then the children will have missed school time that they can not afford.

    When my family came to the UK in End August, the kids were in (private) school in the Philippines until the day they came here. To me, not missing out on education was more important than the school fees.

    Why don't you pay the fees in instalment. Then you limit your losses.

    If you choose not to, then I don't suppose it will do any harm to use last year's school records.

    How old are the children? My stepson is seven and the differences between his schooling in the Philippines and here were so great that his school here arranged remedial help for him - which was very nice of them. He is making good progress now.

    Hello! Thanks for the reply. I appreciate it much. But I have another concern. I came here on a fiancee visa last year and just got married this year and I already had an FLR1, so if I will apply my boys for the visa to join us here, what type of visa they should be applying and what visa application form. I am just really confused. We have no plan on getting a solicitor for them as we cannot afford to coz visa fee alone and other expenses are already too much for us. That is why I myself is the one doing research for it and I hope this website will be able to help me just like it has helped a lot of people. Thank u

    Hello! thanks for the reply. My 2 boys are 14 and 12. When u enrolled your stepson here in UK, did the school asked for any record from previous school? and when u applied him for a visa, did u submit any school record with it as well? Thanks a lot for the time.

    Hello Ginger,

    The school did not ask for any record from his school in the Philippines, and we did not include any school record in the visa application.

    I think that @ChoiAndJohn have two daughters, now here, who are close to the age of your two boys.

    I would suggest that you get them here as soon as possible as the GCSE courses for your older boy will start in September and he really should attend all of those courses.

    Thanks for the prompt reply. Thanks for that info. I also would like to know what type of visa should they apply and what form I should fill in for them? We plan on submitting their visa application on August 2016 because we have to wait for the 6 months pay slip of my husband reflecting his new wage that qualifies the financial requirement for him to be able to sponsor my 2 sons. Your reply is very much appreciated.

    I think they need settlement visas to accompany their mother. The validity will be the same as your own visa - at least Kieran's was the same as his mother's - she arrived on a marriage settlement (fiancee) visa and now has FLR (M) and so does he.

    No, they have to arrive first so they need settlement visas. Then they can extend when they are here. I will look up what we did when I am home, tonight.
