Fiance visa vs. Spouse visa

    Is this both visa's financial requirements are the same?. In your opinion which is better to apply for Fiance visa or Spouse visa?. And is it true that there is more chance to get visa with a spouse visa than fiance visa?.

    exactly the same requirements. an advantage to the spouse visa is it comes with the first FLR--so that saves a lot of money compared to the fiancee visa. but--it means you have the expense of marrying abroad. it also means your spouse is allowed to work straight away if its what you want.

    Both are under Settlement Visa but different categories. Given the applicant and sponsor submit all the specified requirements by the UKVI, the chance in getting either type of visa is pretty much the same.

    You might have a bit more chance of getting a visa with a spouse visa just because being married is an added proof of an existing relationship, but as long as the application is done well then there's probably no real difference other than that.

    For me the worst thing about a spouse visa is you get married then go your seperate ways and live in a different country to your spouse. I wouldn't want to do that.

    The extra expense of the spouse visa is probably offest against the expense of the extra trip abroad to get married, but at least you're getting a holiday out of it too!

    For us it was a fiancee visa. The red tape involved in getting married in The Philippines, plus having to split again after, soon put that idea to bed. We only considered it in the first place because we'd had a fiancee visa refusal on our first attempt.

    Hello guys!. Thank you for the comments.. If you remember me I was asking before about Fiance visa that what we planned to apply for after i deliver our baby.. But we are looking for the advantages of getting married before baby comes.. So i think we will just get married when he is back before i give birth.. It's just the same anyway coz we will still end up getting married anyway..

    So for you guys that's been married here in the Philippines.. How long does it takes to get Certificate of Legal Capacity to Contract Marriage at Uk Embassy and how much do it cost?. Also do my British fiance needs to get CENOMAR issued by NSO?. We just want a Civil wedding.. Any advice how to do this would help.. Thank you in advance!.

    Yup we had to get a copy.. pretty straight forward to get tbh.. but also there is many other documents required for U & him to marry in phills.. but theres plenty info on here to help you out.. im not sure for timescale to get marriage contract im about to ask that same Q..

    We supposed to marry here in philippines but then when my husband try to book an appointment in thrthe brit embassy they said that he need to be here for 3weeks first before he can request for his singleness so after 3weeks we requested for appointment and received email after 3weeks again that his appointment will be in 2weeks and it will be posted for another 3weeks (21days) but then he need to leave for work, the ending is i applied dor a marriage visit visa in the uk...

    Hi this a message I got from one of our helpful member, hope this can help us guys!.

    Hi, I married my wife in Manila last September. It was easy enough to sort out.
    To register the marriage in the uk you need to visit your local registry office in the uk and have the marriage posted in the town hall for 28 days before you can travel to the Philippines. Then you will need to book an appointment at the British embassy in Manila or Cebu to obtain an affidavit that your free to marry.
    Then its a trip to you town hall in Phil to do all the paperworks needed.
    Sounds like a lot but we found it all very easy just make sure you have all the paperwork you need and double check it all. You will need to be in Phil for 14 days before the date of your wedding.

    Your husband didn't do the posted in UK is that why they asked him that he needs to be here in the Philippines for 3weeks first for it?. My Fiance is divorced and he got his Divorce absolute decree.. Also he was been here 4x.. First for 1month, second for 3months, then last 2 was for 1month.. So we still need waiting for all those weeks coz he can only get a month holiday off work..

    Seriously, it's a myth that a spouse visa is easier to get than a fiancé visa. The rules are that you've actually met and plan to marry.

    I got married in the Philippines, but if I could turn back time it would've been here in the UK.

    Is it because there is NO DIVORCE here in the Philippines Kuya?. Or can a marriage be divorce in UK even married in the Philippines?.

    When it comes to getting divorced, or an annulment as they have them in the Philippines. Yes, those have to be proven to the UK immigration officer, but there is no more evidence required to prove an actual relationship if you're married in the Philippines or choose to marry in the UK.

    Avoiding getting into the financials. You only need to prove that you can both legally marry, you've met in person and have an actual relationship together. The burden of proof is the same for a spouse visa or a fiancé visa, exactly the same.

    Yeah you are right.. But we are also thinking of our baby and visa.. Might be easier for us to get baby's british passport when are legally married.. Like we don't need to take DNA test anymore.. We gonna have lots of expenses going already plus DNA test could be really really expensive.. And like i heard you don't need to file for FLR that will also saves us money..

    Both have pros and cons. It depends what suits you and your situation.

    We went for the Spouse visa and marriage in the Philippines. The two processes are effectively the same though not exactly so.

    In our case the mother in law insisted on a Philippine wedding. A Philippine wedding is likely to be cheaper than here in the UK, though you will have the added expense of a flight out to the Philippines if you are based in the UK. But a Philippine wedding is a great chance for a Philippine honeymoon!

    With the actual visa process the fiance visa throws up an extra stage and fee to go with it. And proof of intent to marry in the UK can be a tricky one though still do-able.

    I cant advise you on that as the requirements are not the same as when we went through the process. But from those that have done it, it seems to be easy enough.

    There have been a couple of threads on it. Did you mean Legal Capacity or Affirmation to Marry?

    The Affirmation to Marry appears to have replaced the UK Embassy Certificate of No Impediment ( CNI ) equirement.
