Hi Guys, I have been refused a visitor Visa for the women i love. We applied ourselves and there was a couple of mistakes but they seemed to have gone to town with our rejection of the visa. They passed my financials, but rejected it due to the following. 1. She filled the wrong amount of wages she gets . She put down more as where she is staying is included with her job, but has no evidence of this. But there was a covering letter from myself explaining this. 2. Not satisfied in a guanine relationship. I put 2 messages in the application and some photos of us together. We have meet, i also put copies of my flight tickets. Her name on messenger if different than her real name, which didnt help. Her name is Suzette and her messenger says Zet. 3. Not given notice of marriage or intend to. I was under the understanding you cant give notice to marry in the uk without your partner being with you? 4, not satisfied that the visit will be for a short time. Goodness knows why and how you would show its only for a short time. 5. Refers to the sponsors inability to prove she will leave after the visa runs out. We are both gutted and im not sure what to do. I would go to the Philippines and get married, but i am unsure how this visa rejection will effect the settlement visa. I believe i cant appeal the ruling or should i redo the visa application again?
First question is whether you applied for visit visa or marriage visit visa as they will be treated differentially. Key thing with visitor visas is showing that she will leaves the end of the visa. 1. Need to get all details correct. If she has a job and she is going to return to it after the visit then need letter from employer granting her leave of absence and confirming get will be returning to the job after the visit. That is part of the evidence of returning 2. Evidence of relationship seems bit weak. Messenger extracts with correct name over a longer period is really required. We had evidence over 12 months plus of messages (one page a month). Likewise the more photos of both of you in different surroundings the better. (We had cebu, coron and singapore on different trips with copies of flights and hotel bookings and also family pictures as well. 3. Evidence of marriage would only be appropriate for marriage visa. Evidence to support this woukd be email to registry office asking about process and details of ehen you intend to get married. They will respond to explain the processincluding the fact that both of you have to be in the UK for seven days before you can get married and various other details. Add the email to the evidence. 4. This is where you have to prove intention to leave at end. Examples will be letter from employer, bank accounts in philippines with significant balances, commitment to housing or house ownership etc. 5. For visit visa the emphasis is on applicant proving that they will leave at the end of the visit. If it comes across as you proving that she will leave then easy to say what she won't. We used arguement that had not yet decided on where to live long term so were not applying for fiance visa and if necessary would return to Philipines and apply from there. We also supplied bank statements with balances over a period (banks have a particular format that the embassey can validate) copies of house rental contract with letter from land lady Helps to have evidence of visiting overseas countries and leaving on time. We had visit to Singapore together. I also provided copies of bank statements and payslips to underpin that met requirements for fiance visa if necessary. I also had evidence of multiple visits to Philipines to meet up and subsequent trios within the Philippines. Cannot appeal visit visa refusals and have to do new one. New application will have to address refusal points and also detail previous refusals. Visit visa refusals should not impact on spouse or fiance applications unless some evidence of deception in previous applications. To a certain extent we used the marriage visa process as a test run for the spouse visa application as it identified a number off things that we had to address for that.
Hi welcome and take a deep breath, put the refusal behind you and focus on a new application. We have just completed my wife's eldest daughter's and grandchild 3rd visit visas and are ready to submit She doesn't have a job nor a house in the Philippines. We have been successful with 2 visit visa for her. What UKBA look for is A reason or reasons the applicant will return home at the end of the visa. Have they enough money to support themselves for the trip or if somebody else is funding the trip have they got enough money! Reading your op you appear to of given them a muddled application. It's good she has a job! Personally I wouldn't bother with trying to explain her additional living cost where she stays as a cash benefit just declare figures seen in her bank account, can you by way of bank statements show enough savings to support her trip? As a guide we supplied my easy access savings account that has about £5k in it. Do not mention marriage on the visa application as there are other visas for that do not give the impression you are trying to short cut their processes Genuine relationship again normally asked to prove if you are targeting a longer term visa. Where it asks reason for trip.... general sightseeing and holiday will do. These are just a few initial pointers and whatever you do don't bombard them with too much information ( they will either pick holes in it or ignore) Strongly suggest you go on uk gov visa sight and practice filling in the form you can alter it as many times as you like!
If you plan to marry..where do you intend to live? This dictates the type of visa she has to apply for.
Hi kevinzet, If you are sure you want to marry the lady, get married in the Philippines - it is a wonderful experience and you will get to understand more about her people and the country she is from. My wife and I married in Cebu province back in 2008.
Hi, Thank you. thats what we are going to do. Its far less hassle than getting married in the uk. Sad my family wont be there but well worth it. I fell in love with the place when i went there last year.
Well, she will come o the uk once we are married. I know i will have to apply for a settlement visa once i am back home. I know there are changes coming regarding that. I have at least learnt a lot by doing this vistor visa and should stand me in good steed for doing the settlement visa. They oked my fiances so thats a good start.
yes its great fun, we married there in 2015 with all her family around her and a couple of my grown up sons.
Everyone will make you feel very welcome on your marriage day in the Philippines and the "lechon baboy" is nice, well it was back then as I used to eat meat back in the day
Thats the thing, i am quite glad that the visa got refused now apart form the thought of taking 2 lots of flights there and back again.
do bear in mind--if you do get married over there--then she applies for a settlement:spouse visa--it will take an agonizing 2 to 3 months for a decision before she can get on the plane. or apply for a settlement: marriage ( "fiancee") visa--same waiting period till she gets the decision--then she flies here--you get married within the 6 months timeframe the visa permits--then she applies for further leave to remain. for another 30 months. then repeat. the requirements for each are the same.
Yes i am aware thanks. We have been together for over a year and half so i am sure the wait will be worth while.We have been waiting some time now already. Ive got her looking at some example questions for the English language exam and will get her to do that first before i get the first flight over there. She works and is living in Dubia at the moment, so makes things complicated. At least i have had a practice with the visit visa and should be well prepared when it comes to the settlement visa. very true...but i wouldnt want to leave my new wife behind for that length of time while waiting for her visa. she might forget who i was.
